According to the Construction Contract No. 05/2013/HD-XD for the construction of the Muong Long Cultural House (Ky Son) between the People's Committee of Muong Long Commune (Party A) and Thanh Nam Company Limited, Vinh Branch (Party B), represented by Director Ho Thi Hai Lieu, address 142, Nguyen Phong Sac Street, Vinh City, signed on July 10, 2013, the contract implementation period is 4 months to complete the project and hand it over for use (the construction start date is 1 day after the contract takes effect). According to the contract, the project will be accepted, completed, and handed over for use on November 11, 2013. The contract states an extension of the completion period if due to 1 of 3 reasons: there is a change at the request of the investor that affects the progress; due to the impact of force majeure events such as earthquakes, storms, floods, etc.; Delays and obstacles on the construction site due to incorrect handover of the site and related procedures affecting the progress of contract implementation.

According to Mr. Va No Vu - Secretary of the Party Committee of Muong Long Commune and Mr. Xong Va Sua - Chairman of the People's Committee of Muong Long Commune, during the construction of the project, there were no problems due to the 3 reasons mentioned above. Everything went smoothly, right after the groundbreaking ceremony, the construction unit quickly carried out site clearance, gathering materials and constructing the project. The investor quickly resolved the advance payments and payments to create favorable conditions for the contractor to construct. Therefore, in the first 4 months, the shape of a 7-room cultural house, quite impressive and spacious... gradually appeared in the anticipation and excitement of the cadres and people of Muong Long Commune.

Everything was going smoothly, but taking advantage of the investor's gullibility and limited management skills, the Muong Long Commune People's Committee paid the basic amount according to the contract price, and the construction unit left when the project was still unfinished. We tried to contact them but couldn't get through...", Mr. Va No Vu - Secretary of the Muong Long Commune Party Committee reflected. After the 4-month deadline as prescribed, the construction progress did not meet the contract, the supervision consultant and the contractor both "had no comments".
Mr. Xong Va Sua - Chairman of Muong Long Commune People's Committee said that the contractor let the workers work slowly until April 5, 2014, then left. Up to now, no one has come back to work. Both Mr. Vu and Mr. Sua confirmed that they had contacted many times a man named Hoang - who appeared in Muong Long Commune as the contractor's representative, with phone number 0915xxx789, and a man named Hoa with phone number 0915xxx866 - who often appeared to direct the construction. But Mr. Hoang always promised to come next week, but he has not appeared yet, and Mr. Hoa never answered the phone.
Thus, up to now, it has been more than 1 year past the construction deadline according to the contract (from November 11, 2013), but the contractor has not yet completed the project. Currently, there is only the Minutes of acceptance and payment for the completed construction and installation phase (phase I) on October 28, 2013. At the construction site, the unfinished items, 7 houses have roofs, walls are plastered, but the foundation, main door, windows, lights, ceiling fans, and yard floor have not been done yet. The main doors and windows have not been installed, the floor is a mess of dirt and bricks and mortar...
While the people of Muong Long commune are lacking space for cultural activities as well as organizing other community activities, the project is being left unfinished, which is a huge waste. The delay in completing and handing over the cultural house for use not only causes difficulties in collective activities, but also makes the officials and people here angry and dissatisfied. It is worth mentioning that to build the Muong Long Cultural House, the people contributed money and labor days worth about 80 million VND.
Faced with that situation, the People's Committee of Muong Long commune has twice sent official dispatches to the People's Committee of Ky Son district (Report No. 13/BC-UBND dated September 4, 2014 and Report No. 18/BC-UBND dated October 17, 2014 of the People's Committee of Muong Long commune). However, up to now (November 22, 2014), the People's Committee of Muong Long commune has not received any response from the relevant parties. This incident shows signs of contract breach by the contractor. It is thought that the authorities need to intervene soon to clarify the matter. This is also the desire of the government and people in the "heavenly gate" of Muong Long to soon complete and put the communal cultural house into use, serving the community activities of the people in the border areas of the Fatherland.
