Some new points regarding the election regulations within the Party.
On October 10, 2024, the 13th Central Committee of the Communist Party of Vietnam issued Decision No. 190-QD/TW, along with the Regulations on Elections within the Party.

The regulations consist of 7 chapters and 36 articles, and apply to elections at branch party congresses, party committee congresses at all levels; elections at executive committee meetings, inspection committee meetings, etc. Party committees and organizations that nominate party members to run for leadership positions in the State, the Fatherland Front, political and social organizations, and mass organizations assigned tasks by the Party and the State shall apply these regulations.
Election principles:Party elections are conducted according to the principles of democratic centralism; equality, direct election, and a simple majority. Election results from the grassroots level to the Party committees directly under the Central Committee must be approved by the competent Party committee as prescribed.
Election format:Secret ballots are conducted in the following cases: Election of Party committees and branches (referred to as Party committees); election of the Central Committee of the Party; election of the Standing Committee, secretary, and deputy secretary of Party committees; election of the Politburo, General Secretary, and Secretariat; election of the Inspection Committee, chairman, and vice-chairman of the Inspection Committee; election of delegates to the Party congress at the higher level; soliciting opinions on candidates to be included in the electoral list; and nominating Party members to run for leadership positions in the State, the Fatherland Front, political and social organizations, and mass organizations assigned by the Party and the State.
Voting by show of hands (using party membership cards) is used in the following cases: Electing executive and support bodies of congresses and conferences (presidium of the congress, secretariat, congress secretary, conference chairman, committee for verifying delegates' credentials, vote counting committee). Approving the number and list of candidates for election.
The election regulations stipulate the responsibilities of the Party committee that convenes the congress:
1.Prepare personnel proposals for delegates to the higher-level congress; personnel proposals for the Party Committee, Standing Committee, Secretary, Deputy Secretary, Inspection Committee, Chairman of the Inspection Committee, Deputy Chairman of the Inspection Committee, and the conditions for organizing the first Executive Committee meeting to elect the Standing Committee, Secretary, Deputy Secretary, Inspection Committee, and Chairman of the Inspection Committee at their level according to regulations.
2.Receive applications for candidacy to the Party Committee from full Party members who are not delegates to the Congress (submitted to the Party Committee no later than 15 working days before the official opening of the Congress) to direct verification and forward them to the Presidium to report to the Congress for consideration and decision.
3.Announce the number of delegates and allocate delegates to subordinate Party committees and branches. Direct the election of delegates to ensure compliance with prescribed principles and procedures. Decide and announce the opening time of the congress 30 working days in advance.
4.Provide documentation to the committee verifying the qualifications of delegates regarding the situation, election results, and issues related to delegate eligibility.
5.Provide documents to the presidium to answer questions raised by party members and delegates at the congress regarding the candidates.
6.Prepare documents for the new Party Committee to elect the leadership positions of the Party Committee and the new Inspection Committee at their respective levels during the first meeting.
7.Prepare the number, list, and personnel of the presidium, the chairman of the congress, the secretariat, the congress secretary, and the committee for verifying the credentials of delegates for submission to the congress for consideration and voting.
Regulations regarding the right to vote:
1.Only official delegates of the congresses at all levels and official party members of the party congresses have the right to elect their respective party committees and delegates to the higher-level party congresses.
2.At the party congress, temporary party members and probationary party members do not have the right to vote.
Regulations regarding the balance and list of candidates:
The number of candidates on the list for the Party Committee and Standing Committee must be greater than the number to be elected; the maximum surplus is decided by the congress (conference) but shall not exceed 30% of the number to be elected, of which the Party Committee convening the congress (conference) shall prepare a surplus of 10% - 15% for the Party Committee and Standing Committee. The list of candidates prepared by the Party Committee convening the congress (conference) is the official nomination list submitted to the congress (conference).
The Party branch congress directly elects the Party branch committee, then elects the secretary and deputy secretary from among the committee members; where no Party branch committee is elected, the Party branch elects the secretary, and if necessary, a deputy secretary. Party congresses from the grassroots level to Party committees directly under the Central Committee, when directly electing the secretary, conduct a nomination process after the election of the Party branch committee, collecting nominations from Party members or delegates of the congress for the secretary position; compiling the nominations and reporting to the higher-level Party committee before proceeding with the election of the secretary. Only after receiving guidance from the higher-level Party committee can the election of the secretary be conducted.
Calculate the election results:
1.The election results are calculated based on the number of valid votes; a valid vote is one that meets the criteria specified in Article 15 of these Regulations. In the case of multiple votes with no remaining votes, if a voter marks an X in both the "agree" and "disagree" boxes, or does not mark an X in either the "agree" or "disagree" boxes corresponding to a person's name, that person's vote will not be counted in the election results (that vote will still be considered valid).
2.For party congresses: The elected candidate must receive more than half of the total number of official party members of the party committee or branch convened, excluding party members who have been temporarily assigned to other party committees, party members who have been exempted from party work and activities and are not present at the congress (if such party members are present at the congress, party member meetings, participate in elections, or vote, they are still counted), party members whose party membership has been suspended, who have been prosecuted, or who are temporarily detained, and official party members who are absent throughout the congress for legitimate reasons approved by the party committee convening the congress.
3.For the delegate congress: The elected candidate must receive more than half of the total number of official delegates summoned, excluding the number of committee members at the level convening the congress who are absent throughout the congress, and official delegates who are absent throughout the congress without alternate delegates to replace them.
4.At the Party Committee meeting to elect the Standing Committee, Secretary, Deputy Secretary, Inspection Committee, and Chairman of the Inspection Committee, the elected candidate must receive more than half of the total number of Party Committee members, excluding members who have temporarily transferred their Party membership and are not present at the meeting, and members who are suspended from Party activities, prosecuted, or detained.
5.If the number of candidates receiving more than half of the votes exceeds the number of positions to be filled, the candidates with the highest number of votes will be selected from top to bottom until the required number of positions is filled.
6.If, at the end of the list of elected candidates, there are many people with equal votes, and this number exceeds the required number of candidates, the chairman or the presidium of the congress (conference) shall compile a list of those tied candidates for the congress (conference) to re-elect. The candidate with the higher number of votes will be chosen, not necessarily by more than half. If, after the re-election, the number of votes remains equal, the congress (conference) shall decide whether or not to continue the election.
The percentage of votes is calculated based on the proportion of delegates in the delegate congress or party members in the convened party congress.
