According to the defendant's testimony as well as the collected evidence: On March 16, 2019, P had a party with friends at a restaurant in Quynh Phuong ward (Hoang Mai town). After the party ended, Nguyen Le P drove a car with license plate 37A - 456.71 to take some friends home.
When arriving at Km 0+850, National Highway 48E, P. drove his car on the right side of the road at a speed of 20 km/h. At this time, Mr. Pham Dinh D (born in 1940), residing in Quynh Phuong ward (Hoang Mai town) was walking in the same direction as P.'s car. Discovering Mr. D walking, Nguyen Le P. honked his horn to signal and continued driving normally.
However, when approaching Mr. D's location, because Nguyen Le P. focused on looking at the left rearview mirror to observe behind, the front right side of the defendant's car collided with Mr. D.
Mr. Pham Dinh D. was taken to the emergency room immediately afterwards. However, due to the severity of his injuries, the victim died on the way to the emergency room. Nguyen Le P. was found to have a breath alcohol concentration of 0.515 mg/l, exceeding the legal limit.
At the first instance trial of the People's Court of Hoang Mai town, defendant Nguyen Le P. was sentenced to 24 months in prison. However, because he was the main breadwinner of the family, his wife worked far away, and his children were still young, the defendant filed an appeal to the Provincial People's Court for a reduced sentence.
Based on the details in the case file, the Provincial People's Court found that there were no aggravating circumstances in the case, and that the parents were people who had contributed to the revolution, so it decided to accept Nguyen Le P.'s appeal and sentenced him to 12 months in prison./.
