How do victims of human trafficking get legal assistance?

According to Article 21 of Decree No. 162/2025/ND-CP dated June 29, 2025 of the Government, legal aid support for victims of human trafficking is implemented to ensure the right to access the law and protect their legitimate rights and interests. The Decree has specified the groups of subjects receiving support, the content of support and the agency responsible for implementation.

Regarding the subjects eligible for legal aid, the law stipulates that it includes victims who are Vietnamese citizens, stateless persons who are permanent residents in Vietnam, as well as persons under 18 years of age accompanying these people. In addition, persons in the process of being identified as victims, belonging to the above-mentioned groups and currently in the country, are also entitled to access legal aid services. In addition, victims and persons in the process of being identified as victims of foreign trafficking in Vietnam are also eligible for support under Vietnamese law.

Regarding the support regime, the above-mentioned persons will be provided with legal aid related to the content related to the case or human trafficking case. The forms of support include legal advice, participation in litigation, representation outside of litigation and other forms as prescribed by law on legal aid. For foreigners who are victims or are in the process of being identified as victims of human trafficking in Vietnam, legal aid will be provided based on the specific needs, actual situation of each case and the length of their stay in Vietnam.

Regarding the implementing agency, the responsibility for providing legal aid to the above subjects belongs to the State Legal Aid Center and organizations participating in providing legal aid according to the provisions of law. The order and procedures for providing legal aid are applied according to the general provisions of the Law on Legal Aid and the documents guiding its implementation.
