Can people of Vietnamese origin whose nationality has not been determined be issued an identity card?
Mr. Nguyen Van Tung, residing in Que Phong district, asked: What is an identity card? Can people of Vietnamese origin whose nationality has not been determined be granted an identity card? If so, what conditions must be met?
Reply:
An identity card is an identification document containing the identity of a person of Vietnamese origin whose nationality has not been determined, issued by an identity management agency in accordance with the provisions of the 2023 Identity Card Law (effective from July 1, 2024).
-Clause 1, Article 30, Law on Identification 2023 stipulates: Identity certificates are issued to people of Vietnamese origin whose nationality has not been determined but who have been living continuously for 06 months or more in commune-level administrative units or district-level administrative units where there are no commune-level administrative units.

A person of Vietnamese origin whose nationality has not been determined and who is living in Vietnam is a person who is living in Vietnam and does not have papers or documents proving Vietnamese nationality or nationality of another country, but has the same direct bloodline as a person who used to have Vietnamese nationality as determined by the principle of consanguinity.
Thus, from July 1, 2024, people of Vietnamese origin whose nationality has not been determined will have the right to be granted, change, or re-grant identity cards.
However, identity cards are only issued to people of Vietnamese origin whose nationality has not been determined but who have been living there continuously for 6 months or more.
-Clause 2, Article 30 of the 2023 Law on Identification also stipulates the management of identification for people of Vietnamese origin whose nationality has not been determined and who are granted identification certificates, including:
a) Collecting information on the identity of people of Vietnamese origin whose nationality has not been determined;
b) Update, adjust, exploit and use information on the identity of people of Vietnamese origin whose nationality has not been determined and has been collected in the National Population Database and the Identity Database;
c) Establish personal identification numbers for people of Vietnamese origin whose nationality has not been determined;
d) Granting, exchanging, re-granting, revoking, retaining and returning identity certificates.
