In Phong Thinh commune (Thanh Chuong district), Mr. Hoang Viet Hong (born in 1959) used to have a close relationship with Dao Van Dung (born in 1972). Not only did they live in the same neighborhood, but they also had a close relationship as uncle-in-law and nephew-in-law. Every day, in addition to traveling and helping each other in daily life, the two sides occasionally had a few friendly drinks. However, just because of an unclear suspicion, Dung beat Mr. Hong seriously, leading to conflicts that forced the uncle and nephew to drag each other to court.
The incident happened on September 9, 2012. That day, Mr. Hong went to Dung's house and was invited to drink alcohol. His uncle refused, so Dung drank alone. After a few drinks, Dung got on his motorbike to go to his parents' house. On the way, Dung saw his aunt herding cows with a bruised face. He suspected that Mr. Hong had beaten her, so he went back to find her.
Meeting Mr. Hong, Dung asked, “Why did you hit my O?”, then used his foot to kick the opponent in the stomach. Falling to the ground, Mr. Hong raised his hands to block but was hit by Dung on the hands and the top of the head, causing him to faint. Only then did Dung stop and call for someone to take the victim to the hospital. The results of the treatment at the hospital showed that the victim suffered a traumatic brain injury, 3 broken ribs, and was in a coma for 13 days. After treatment at the hospital, he had to continue rehabilitation treatment.

He was blocked on the road by his nephew and severely injured, but because of the family ties and not wanting to make a big deal out of it, Mr. Hong did not ask the authorities to get involved. Even when his son urged him to report Dung, he could not bear it. For a long time, Mr. Hong silently endured a lot of physical and mental pain.
...The wind never stops
But after 5 years, Mr. Hong changed his mind and decided to file a petition to prosecute Dung for assault. Dao Van Dung was later prosecuted by Thanh Chuong District Police for intentionally causing injury.
In 2018, the Thanh Chuong District People’s Court sentenced Dao Van Dung to 5 years in prison for the above crime. Dung appealed, believing that the sentence was too harsh. However, at the appeal hearing held at the end of May 2019, Dung withdrew his appeal, only asking for a lighter sentence.
In court, explaining the reason for "dredging up" the case, Mr. Hong said that in 2017, as the head of the bank loan group, he called Dung to come to his house to pay the overdue loan. However, Dung did not pay and cursed, claiming that all the money had been compensated to Mr. Hong. Here, Dung also threatened to beat Mr. Hong. The incident was later resolved by the commune and district levels but was unsuccessful.
Mr. Hong submitted a petition to the police.
The sad victim said that since the incident, his life has been turned upside down. Two months after he was beaten by his nephew Dung, his wife also passed away due to a serious illness. When talking about his wife, his heart is heavy again. “She worked hard all her life for her husband and children. I often work far away in the South, so she was in charge of all the farm work. In 2004, while carrying a pesticide sprayer, she was poisoned and suffered from many diseases. Among them, my wife suffered from Alzheimer's disease (memory loss), which disrupted all her daily activities, sometimes even making it impossible to cook. Then she passed away while I was in the hospital. That day, a sudden thunderstorm came, because she was absent-minded, my wife did not go into the house, caught a cold and passed away not long after,” Mr. Hong said.
Since his wife fell ill, he decided to quit his job in the South and return to his hometown to open a motorbike repair shop. But after just 3 months of opening, an incident happened and the shop closed. He confided that with his motorbike repair job in his hometown, he earned more or less a hundred a day. But since being beaten by Dung, he suffered a brain injury and his hands were also injured, so he was almost disabled. Moreover, the effect on his nerves caused him to have seizures that he could not control, so he had to always keep medicine with him.![]() |

Since his wife passed away, his children have started their own families and some are working far away, so he has been left to fight his illness alone. With a 44% mental loss, Mr. Hong has been unable to do much. At court, the victim requested the court to sentence the right person for the right crime.
Considering that the defendant has a sincere attitude, knows how to repent, and actively compensates the victim according to the first instance judgment, the panel of judges partially accepts the appeal, amends the first instance judgment, and sentences Dao Van Dung to 3 years in prison. Regarding civil liability, the defendant is required to compensate Mr. Hoang Viet Hong a total of more than 108 million VND.Although the defendant’s sentence was lower than the first instance verdict, Mr. Hong accepted it because he did not want to push his nephew into a corner. Above all, he wanted to close the case that had lasted for 7 years.
