The National Assembly discusses the draft Law on Temporary Detention and Custody.

On November 9th, at the beginning of the third week of the 10th session, the National Assembly discussed in the plenary hall several contentious issues in the draft Law on Temporary Detention and Custody.

Overview of the 10th session of the 13th National Assembly

The draft Law on Temporary Detention and Custody, prepared by the Ministry of Public Security, consists of 11 chapters and 73 articles.

The draft Law stipulates: the principles, responsibilities, and procedures for temporary detention and custody, and the supervision of the implementation of temporary detention and custody; the organizational structure, tasks, and powers of agencies implementing temporary detention and custody; complaints, denunciations, and the resolution of complaints and denunciations in the implementation of temporary detention and custody, and the rights and obligations of relevant organizations and individuals...

On May 23, 2015, reporting at the 9th session of the National Assembly on the draft Law on Temporary Detention and Custody, Minister of Public Security Tran Dai Quang stated that in recent years, the implementation of the temporary detention and custody regime has been strictly organized, effectively serving the activities of investigation, prosecution, trial, and execution of sentences. This has contributed to the fight against crime, firmly protecting national security, and ensuring social order and safety.

However, alongside the advantages and achievements, the implementation of the temporary detention and custody regime has also revealed many shortcomings and limitations. Therefore, the drafting and promulgation of a Law on Temporary Detention and Custody in the current situation is necessary.

On June 19, 2015, the National Assembly discussed this draft law.

Subsequently, the National Assembly's Judicial Committee announced that it had received 46 written comments on the draft Law on Temporary Detention and Custody. The comments focused on several issues, including: the title and scope of the draft law; the rights and obligations of those temporarily detained or in custody (Article 9); the organizational model, tasks, and powers of the competent authorities and individuals in the execution of temporary detention and custody (Articles 10 and 12 of the draft law); and the treatment of those temporarily detained or in custody…

Also on the morning of November 9th, the National Assembly will hear Minister of Justice Ha Hung Cuong, authorized by the Prime Minister, present the Report summarizing the continued implementation of the pilot program for the institution of bailiffs according to Resolution No. 36/2012/QH13 dated November 23, 2012 of the National Assembly and the Draft Resolution on the implementation of the institution of bailiffs.

In the afternoon, the National Assembly held group discussions on the summary of the continued implementation of the pilot program for the institution of bailiffs and the draft Resolution on the implementation of the institution of bailiffs; and gave opinions on the draft Law on Auctioning Assets.
