National Assembly discusses draft Law on Detention and Temporary Imprisonment

On November 9, opening the third working week of the 10th session, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Detention and Temporary Imprisonment.

Overview of the 10th session of the 13th National Assembly

The Draft Law on Detention and Temporary Imprisonment was drafted by the Ministry of Public Security; it consists of 11 chapters and 73 articles.

The Draft Law stipulates: Principles, responsibilities, temporary detention and custody regimes and supervision of the implementation of temporary detention and custody regimes; the organizational system, tasks and powers of agencies implementing temporary detention and custody regimes; complaints, denunciations, settlement of complaints and denunciations in the implementation of temporary detention and custody regimes and the rights and obligations of relevant organizations and individuals...

On May 23, 2015, reporting at the 9th session of the National Assembly on the draft Law on Temporary Detention and Temporary Imprisonment, Minister of Public Security Tran Dai Quang said that in recent years, the implementation of the temporary detention and temporary imprisonment regime has been closely organized, effectively serving the activities of investigation, prosecution, trial and execution of sentences. Thereby contributing to the fight against crime, firmly protecting national security, ensuring social order and safety.

However, in addition to the advantages and results achieved, the implementation of the temporary detention and temporary imprisonment regime has also revealed many shortcomings and limitations. Therefore, the development and promulgation of the Law on Temporary Detention and Temporary Imprisonment in the current situation is necessary.

On June 19, 2015, the National Assembly discussed this draft Law.

Afterwards, the National Assembly's Judicial Committee said it had received 46 documents providing comments on the draft Law on Detention and Temporary Detention. The comments focused on a number of contents such as: On the name and scope of the draft Law; on the rights and obligations of detainees and temporary detainees (Article 9); on the organizational model, tasks and powers of agencies and competent persons in the enforcement of detention and temporary detention (Articles 10 and 12 of the draft Law); on the regime for detainees and temporary detainees...

Also in the working program on the morning of November 9, the National Assembly will listen to Minister of Justice Ha Hung Cuong, authorized by the Prime Minister, present a report summarizing the continued implementation of the pilot bailiff institution according to Resolution No. 36/2012/QH13 dated November 23, 2012 of the National Assembly and the Draft Resolution on the implementation of the bailiff institution.

In the afternoon, the National Assembly discussed in groups the summary of the continued implementation of the pilot bailiff institution and the draft Resolution on the implementation of the bailiff institution; and gave opinions on the draft Law on Property Auction.
