Regulation 132 of the Politburo: 'Firewall' in law enforcement
(Baonghean.vn) - The new regulations of the Politburo on controlling power to prevent and combat corruption and negativity in investigation, prosecution, trial and execution activities are considered a "firewall" to control power, prevent and combat corruption and negativity in law enforcement activities.
The Politburo issued Regulation No. 132-QD/TW, dated October 27, 2023, on controlling the power to prevent and combat corruption and negativity in investigation, prosecution, trial, and execution of judgments (Regulation 132). Public opinion agrees with and highly appreciates the issuance of this regulation, saying that this is a new step forward in controlling the power to prevent and combat corruption and negativity in the fields of investigation, prosecution, trial, and execution of judgments.
According to Regulation 132, the control of the power to prevent and combat corruption and negativity in investigation, prosecution, trial and execution of judgments is based on the principle of ensuring the centralized, unified, strict and comprehensive leadership and direction of the Party, the supervision of agencies and elected representatives, the Vietnam Fatherland Front, law enforcement agencies, socio-political organizations and the people. From there, all violations of taking advantage of and abusing positions and powers, abuse of power, corruption and negativity in law enforcement are promptly detected, prevented and strictly handled.
Regulation 132 consists of 4 chapters and 14 articles, which stipulate in great detail the acts in the procedural activities from the investigation, prosecution, trial, and execution stages. In the 28 acts of exploitation, abuse, misuse of power, corruption, and negativity that are stipulated, no areas are excluded. The subjects of handling are also not prohibited, from leaders, commanders, to the acts of the lowest-level employees.
The regulation covers a wide range of subjects and fields, and is very specific and detailed in terms of behavior, which will help avoid abuse of power in law enforcement. The regulation not only helps to investigate and try all types of cases resolutely, but also has a high deterrent effect, reducing the number of officials who violate the law.
According to lawyer Nguyen Trong Hai - Director of Trong Hai and Associates Law Firm (Nghe An Provincial Bar Association), Regulation 132 aims to build a clean and transparent litigation apparatus. “Hopefully, Regulation 132 will be a breath of fresh air for litigation activities, serving as an important basis for functional agencies, as well as litigants, or those participating in litigation, and those participating in judicial support activities. At the same time, it will serve as a corridor for consideration and handling of civil servants, public employees, and litigation officers who show signs of violating the law or are involved in corruption and will be immediately handled. If this issue is handled well, the reputation and strictness of the law will be enforced better and better in practice,” lawyer Nguyen Trong Hai shared.
It can be said that Regulation 132 is like a “firewall” to control power, prevent and combat corruption and negativity in investigation, prosecution, trial and execution activities. From this regulation, each cadre, party member and person working in the judicial sector will self-reflect, self-correct, uphold the sense of responsibility in performing their duties, and be more worthy of the role of “protector of the scales of justice”.
