May I ask about the legal regulations on annual land use plans at district level according to the current Land Law? The issue of concern of Ms. Nguyen Thi Hoa (Nghi Loc, Nghe An).

Reply:Pursuant to Article 67 of the 2024 Land Law, the annual land use plan at the district level is stipulated with the following important contents:

1. The basis for making annual land use plans at district level includes:

a) Provincial land use plan; district land use plan; construction plan; urban plan in cases where district land use plan is not required;

b) Current status of land use; results of implementation of land use plan of previous year;

c) Land use needs and capabilities of sectors, fields, levels, and organizations; projects and works with investment policies;

d) Ability to invest and mobilize resources to implement land use plans.

2. Criteria for selecting priority projects and works in the annual district-level land use plan include:

a) Ensuring national defense and security;

b) Economic, social and environmental efficiency;

c) Feasibility of implementation.

3. The content of the annual district-level land use plan includes:

a) Area of ​​land types allocated in district-level land use planning and area of ​​land types according to land use needs of district and commune levels in the planning year and determined for each commune-level administrative unit;

b) List of works and projects expected to be implemented during the year; projects to arrange residential land and production land for ethnic minorities (if any); land area for auction of land use rights, land recovery projects during the year, resettlement projects, production land expected to be compensated for people whose land is recovered;

c) The area of ​​land types, list of works and projects identified in the previous planning year shall continue to be implemented according to the provisions of Clause 7, Article 76 of this Law;

d) Determine the area of ​​land types that need to change the purpose of use for land types that require permission, except for the cases specified in Clause 5, Article 116 of this Law;

d) Solutions and resources for implementing land use plans.

4. Projects not included in the annual district-level land use plan that fall into one of the following cases may be implemented without having to be added to the annual district-level land use plan:

a) There has been an investment decision in accordance with the provisions of the law on public investment under the investment policy decision authority of the National Assembly, the Prime Minister, the head of a Ministry, central agency, or provincial People's Council;

b) There has been a decision approving the investment project in accordance with the provisions of law on investment under the public-private partnership method under the investment policy decision authority of the National Assembly, the Prime Minister, the head of the Ministry, central agency, and the People's Council at the provincial level;

c) There is a decision approving the investment policy, a decision approving the investment policy and simultaneously approving the investor, a decision approving the investor according to the provisions of the law on investment under the authority to decide on investment policy of the National Assembly and the Prime Minister.

d) Projects using land for land recovery purposes as prescribed in Clause 3, Article 82 of this Law.

5. Develop and update annual district-level land use plan data into the national land database.

Thus, based on the above provisions, the annual land use plan at the district level is prepared annually.
