* Transfer of ownership is a mandatory procedure for state management.This content is clearly stated in Clause 3, Article 133 of the 2024 Land Law as follows:

In cases of registration of changes specified in Points a, b, i, k, l, m and q, Clause 1 of this Article, within 30 days from the date of change, the land user must register the change with the competent authority.

Accordingly, within 30 days from the date of change (ie within 30 days from the date of notarization or certification), people are required to register the change at the competent land registration agency.

* Failure to transfer the red book will result in a fine of up to 20 million VND

The requirement to carry out the registration procedure for changes is also demonstrated by the provision of administrative penalties for failure to do so.

According to Clause 4, Article 5 of Decree 91/2019 of the Government, in case of transferring or donating land use rights without registering land changes, the person subject to the penalty is the party receiving the transfer of land use rights (buyer, donee).

The fine is based on Clause 2, Article 17 of Decree 91/2019 of the Government. Specifically, in rural areas, a fine of 1-3 million VND will be imposed if the change registration is not carried out within 24 months from the date of expiration. If the 24-month deadline is exceeded, the transferee will be fined 2-5 million VND.

In urban areas, the fine is twice the fine for each corresponding case in rural areas (maximum 10 million VND/violation). The fine for organizations is twice the fine for individuals, maximum 20 million VND.
