Prosecution of former Chairman of Construction Bank and accomplices

Pham Cong Danh - former Chairman of the Board of Directors of Vietnam Construction Joint Stock Commercial Bank (VNCB) and 35 other defendants have been prosecuted.

On May 9, the Supreme People's Procuracy completed the indictment to prosecute Pham Cong Danh - former Chairman of the Board of Directors of Vietnam Construction Joint Stock Commercial Bank (VNCB), Chairman of the Board of Directors and General Director of Thien Thanh Group Company Limited, and 35 defendants in the case.

Accordingly, defendant Pham Cong Danh was prosecuted for two crimes: intentionally violating State regulations on economic management causing serious consequences and violating regulations on lending in the operations of credit institutions.

With the first crime, Pham Cong Danh and his accomplices caused damage to VNCB totaling more than 7,000 billion VND.

Specifically, Pham Cong Danh directed and organized the creation of fake records on upgrading the Corebanking system, causing a loss of VND 63.276 billion to VNCB; directed and organized the creation of fake records on renting headquarters at 268 To Hien Thanh and 816 Su Van Hanh, District 10, Ho Chi Minh City, causing a loss of VND 581.6 billion; directed the withdrawal of VND 5,190 billion at VNCB without the consent and signature of account holder Tran Ngoc Bich at VNCB on the payment orders and withdrew VND 300 billion at VNCB without loan records (related to six savings books of three individuals).

In addition, Pham Cong Danh also directed the issuance and investment of bonds against regulations, causing losses of VND 903 billion to VNCB.

Regarding the second crime, the indictment determined that from December 28, 2012 to March 11, 2014, due to the need for money (to pay debts and for personal use), Pham Cong Danh organized many meetings to direct his subordinates to use the legal entities of 12 companies belonging to Thien Thanh Group and two other legal entities, to create fake business documents for buying and selling raw materials, fake debt repayment plans, create fake minutes of meetings of the Board of Directors, and direct the valuation of land lots to increase many times as collateral to borrow VND 5,000 billion from VNCB.

Danh then directed employees of Thien Thanh Group to transfer or withdraw cash of VND4,700 billion to pay off debts. Danh claimed the remaining VND1,465 billion was spent on customer care but could not provide a specific explanation.

The above actions of Danh and his accomplices caused damage to VNCB of more than 2,000 billion VND.

Pham Cong Danh and 35 other defendants in the case were prosecuted before the Ho Chi Minh City People's Court for trial. The Supreme People's Procuracy authorized the Ho Chi Minh City People's Procuracy to exercise the right to prosecute and supervise the trial of the case.

The defendants Pham Cong Danh, Phan Thanh Mai, Mai Huu Khuong, Hoang Dinh Quyet, Nguyen Quoc Vien, Phan Minh Tung and Bach Quoc Hao were prosecuted for "intentionally violating State regulations on economic management causing serious consequences" and violating regulations on lending in the operations of credit institutions.

The defendants Pham Viet Thep, Tran Van Binh, Nguyen Thi Kim Van and Le Cong Thao were prosecuted for intentionally violating State regulations on economic management, causing serious consequences.

The defendants Nguyen Quoc Thinh, Bui Thi Ha Thu, Nguyen Van Cuong, Tran Thanh Tung, Nguyen An Vinh, Cao Phuoc Nhan, Vuu Thi Dieu, Nguyen Minh Quan, Ho Thi Di, Nguyen Tan Thanh, Nguyen Chi Binh, Nguyen Huu Duyen, Phan Tuan Anh, Le Khac Thai, Lam Kim Thu, Doan Quoc Long, Huynh Nguyen Sang, Vo Ngoc Nguyen Binh, Ly Minh, Nguyen Tien Hung, Hoang Viet Thang, Nguyen Quoc Son, Bui Thanh Nguyen, Dang Dinh Tuan and Thai Minh Thanh were prosecuted for violating regulations on lending in the operations of credit institutions.
