(Baonghean.vn)- After failing to buy a motorbike, Vi Van Ly, his father and two friends went to a grilled pork noodle shop in Tam Hop commune (Quy Hop) for lunch. While going to the restroom, passing by the kitchen, he saw a phone charging, Ly took it and hid it in his pants pocket, then went home.
On the afternoon of February 28, the People's Court of Quy Hop district opened a public criminal trial against defendant Vi Van Ly (born 1990), residing in Lien Hop commune, for the crime of "theft of property".
According to the indictment: At about 10:00 a.m. on November 16, 2018, Ly, his father, and two friends, Vi Van Lam and Lang Manh Thach, all residing in Lien Hop commune, went to a motorbike shop in Tam Hop commune to buy a motorbike but were unable to do so. At about 11:00 a.m. the same day, all four of them went to Mr. Ha Ngoc Lam's grilled pork noodle shop for lunch.
Here, while going to the toilet and passing by the kitchen, Ly saw a Samsung J810 mobile phone charging on the table and had the intention of stealing the property. Ly approached the phone and put it in his pants pocket.

About 10 minutes later, Ly, his father, and two friends left together. When they reached the Chau Loc intersection, Ly's father and Thach took the same car home to Lien Hop while Lam drove Ly back to town to play. At this time, Ly took out his phone, turned it off, used a toothpick to remove the SIM card from the phone, and threw it on the side of the road. At 6 p.m., Ly returned home and hid the stolen phone on the cupboard.
The next morning, Ly took out the stolen phone and turned it on, but could not unlock the password. Realizing that his actions were against the law, that afternoon, Ly went to the Quy Hop police station to surrender for his theft.
At the investigation agency, Ly confessed to his crime. According to conclusion No. 69 of the Quy Hop District Property Valuation Council, the used Samsung J810 phone is worth 5 million VND.
During the process of stealing the phone, Ly did not discuss it with the people who accompanied him, and these people did not know that Ly had committed the act of theft, so they did not consider it a crime.
As for the victim, Mr. Ha Ngoc Lam, he has received his property back so he does not request compensation.
Considering the above acts, the People's Court sentenced defendant Vi Van Ly to 6 months in prison with a suspended sentence, probation period of 12 months for the crime of "theft of property" under Clause 1, Article 173 of the 2015 Penal Code.
