Traffic violation causing fatal accident, sentenced to 18 months suspended sentence
(Baonghean.vn) - On the morning of June 13, Tan Ky District People's Court tried the criminal case against Nguyen Van Manh (born in 1995), residing in Vien Thai hamlet, Nghia Thai commune (Tan Ky) for the crime of "Violating road traffic participation", stipulated in Clause 1, Article 260, Penal Code.
According to the indictment, at about 10:45 a.m. on January 28, 2018, Nguyen Van Manh drove a Yamaha-Exciter motorcycle, silver-blue in color, with license plate 37N1 - 209.59 of his younger brother Nguyen Van Cuong (born in 1996, residing in Vien Thai hamlet, Nghia Thai commune, Tan Ky district) carrying Le Duc Hieu (born in 1993), residing in the same commune, to pick up the bride from Trung Luong hamlet, Tan Xuan commune, Tan Ky district to Vinh Loc hamlet, Nghia Thai commune.

When reaching Km 139 + 300 National Highway 48 E, in Thong Nhat hamlet, Tan Phu commune, Tan Ky district, Nguyen Van Manh drove his motorbike at a speed of about 70km/h and then overtook a vehicle in front.
Seeing that the two vehicles were about to collide, Manh drove his motorbike into the lane of the oncoming vehicle, causing an accident with a motorbike with license plate 37N3 - 5616, pulling a homemade vehicle carrying sugarcane tops driven by Ms. Vo Thi Thu (born in 1980), residing in Tan Thai hamlet, Tan Phu commune, which was parked on the left side of the road in the same direction as Manh.
As a result, Mr. Le Duc Hieu died on the spot, Nguyen Van Manh and Ms. Vo Thi Thu were seriously injured and were taken to the emergency room by people, and the two motorbikes were severely damaged.
After causing the accident, Manh directly arranged compensation for Mr. Hieu's family 36 million VND and Ms. Thu's family 10 million VND.
At the end of the trial, the panel sentenced Nguyen Van Manh to 18 months in prison, suspended.
