On the afternoon of March 20, under the chairmanship of Politburo member and National Assembly Chairman Vuong Dinh Hue, the National Assembly Standing Committee held a question-and-answer session on a group of issues in the field of prosecution.

Attending the question and answer session were comrades: Vo Thi Minh Sinh - Member of the Provincial Party Standing Committee, Chairwoman of the Vietnam Fatherland Front Committee of Nghe An province, member of the 15th National Assembly; Nguyen Nam Dinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Council; National Assembly deputies residing in the province, along with leaders of People's Council committees, a number of departments and branches.

REVIEW AND AMENDMENT OF THE LAW ON CRIMINAL PROCESSING

Responding to the National Assembly deputies' opinions on the viewpoints and solutions to properly implement the Party's policy on protecting people who dare to think, dare to do, dare to take responsibility for the common interest, member of the Party Central Committee, Chief Justice of the Supreme People's Procuracy Le Minh Tri affirmed: Personally, I and the Procuracy sector are determined to continue to be highly determined in implementing the Party's policy on effectively fighting corruption and negativity that the Party and the People are looking forward to.

In the fight against corruption, it is necessary to strictly deal with ringleaders, masterminds, profiteers, and those who cause particularly serious consequences. “The more strictly we deal with this, the more deterrent we are, the better the education will be,” said the Chief Justice of the Supreme People’s Court.

However, according to him, there is a problem that in practice, when applying the law today, there are cases where the implementation is due to orders from superiors, or suggestions from superiors and subordinates must comply; due to inaccurate or incomplete advice, but superiors cannot control it, so the decision is wrong; or risk factors, unexpected inadequacies, and force majeure lead to violations.

The Chief Justice of the Supreme People's Procuracy stated his opinion: If these subjects actively overcome the consequences; correct their mistakes and help the authorities investigate and clarify the cases, then exemption, reduction, and pardon can be applied. However, the current law is still stuck.

He cited the Viet A case which was studied and proposed to be divided into three types by competent authorities: strict handling, lenient handling and no criminal handling (Party disciplinary handling, administrative handling).

However, according to the Chief Justice of the Supreme People's Procuracy, in each specific case with a particularly serious nature, the competent authorities will advise and propose; but there is no general application for all cases. Therefore, he proposed to review and amend the specific provisions on criminal handling of the above cases.

At the same time, the Party has Regulation No. 69-QD/TW dated July 6, 2022 of the Politburo on disciplining Party organizations and Party members who violate the law, clearly stating that if they follow orders from superiors but fail to do so, they will not be disciplined. Therefore, the Chief Justice of the Supreme People's Procuracy recommends that this content be specified in legal regulations.

To prevent corruption, comrade Le Minh Tri said that currently, functional agencies such as the Police, Procuracy, and Court investigate and strictly handle the masterminds who intend to appropriate and profit, so it has a great deterrent effect.

"I believe that the current anti-corruption and anti-negativity policy has had a significant impact on the thinking of those who intend to seriously violate the law," said the Chief Justice of the Supreme People's Court.

In order to avoid corruption, comrade Le Minh Tri expressed that, although there have been many efforts in the past, with the current regime and policies for officials at all levels in general, it is still difficult to live on one's own salary.

"We demand good work, but we also need to research a roadmap and solutions to have a regime and policies that can ensure the minimum level for cadres to feel secure in their work," the head of the Supreme People's Procuracy recommended to the National Assembly and the Government.

THE NATIONAL ASSEMBLY STANDING COMMITTEE WILL ISSUE A RESOLUTION ON QUESTIONING

After the questioning session in the field of prosecution, the questioning session was closed after a day of urgent, serious and highly responsible work.

Previously, on the morning of March 20, 29 delegates raised 50 questions, 6 delegates spoke and debated on a group of issues related to the court sector. Politburo member, Party Central Committee Secretary, Chief Justice of the Supreme People's Court Nguyen Hoa Binh was responsible for answering the main questions.

Concluding the question-and-answer session, National Assembly Chairman Vuong Dinh Hue assessed: The issues selected for questioning are correct and accurate, both topical and important issues closely linked to the requirements of judicial reform, building and perfecting the socialist rule-of-law state of Vietnam.

The course of the questioning session showed that, based on their working experience, the National Assembly deputies raised questions that closely reflected the actual developments and lives, and aspirations of voters and the People. The Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, along with the Ministers and heads of sectors demonstrated a high sense of responsibility, a firm grasp of the current situation of their sectors and fields, and were serious, receptive, and listened to and fully absorbed the valid opinions of the National Assembly deputies, frankly explaining and clarifying many issues.

National Assembly Chairman Vuong Dinh Hue said: The National Assembly Standing Committee and National Assembly deputies highly appreciated the answers to the questions; agreed and acknowledged the solutions committed by the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy and the Ministers at the question-and-answer session. Based on the results of the question-and-answer session for each field and the conclusions of each content, the National Assembly Standing Committee will issue a Resolution on the question-and-answer session.
