'Suoi Xanh project' case: Fines, forced restoration of original land condition!
(Baonghean.vn) - The People's Committee of Nghia Dan district has just issued a decision to fine an individual who arbitrarily changed the purpose of using land for perennial crops in Nghia Hoi commune.
Previously, on May 27, 2021, the People's Committee of Nghia Hoi commune sent Report No. 39/BC-UBNDPeople's Committee of Nghia Dan districtAccording to Report No. 39/BC-UBND, after receiving information that at land plot No. 93, map sheet No. 21 of Dong Hoi hamlet, there was a situation of arbitrary conversion of perennial land to non-agricultural land, Nghia Hoi Commune People's Committee coordinated with the Department of Natural Resources and Environment, Department of Economy and Infrastructure to conduct a field inspection.

Through inspection, it was determined that the land user arbitrarily converted perennial crop land to non-agricultural land, including the following works: cement concrete road along the Sao River canal with an area of 258.9 m²; cement concrete road cutting across the land plot with an area of 177.3 m²; cement concrete yard located in the land plot with an area of 256.4 m², housing area and ancillary works with an area of 71.6 m² (old house). The total construction area is 764.2 m². Of which, the recognized residential land area is 300 m²; the area of illegally converted purpose is 464.2 m².

After the inspection, the People's Committee of Nghia Hoi commune made a record, requesting the land user to maintain the current status of the construction, not to continue to expand or build new construction items from the time of inspection. On May 25, 2021, the People's Committee of Nghia Hoi commune received a petition from Mr. Le Dinh Nam, a citizen of Tan Hong block, Nghia Dan town, presenting the process of land use and arbitrarily changing the land use purpose at land plot No. 93, map sheet No. 21. The People's Committee of Nghia Hoi commune conducted an inspection and made a record of administrative violations in the field of land against the land user, Mr. Le Dinh Nam (Minute of administrative violations No. 03/BB-VPHC dated May 25, 2021).

Pursuant to Decree No. 91/ND-CP dated November 19, 2019 of the Government on administrative sanctions for land violations, the case of Mr. Le Dinh Nam violating Point b, Clause 2, Article 1, Decree No. 91/ND-CP, is beyond the sanctioning authority of the People's Committee of Nghia Hoi Commune. Therefore, the People's Committee of Nghia Hoi Commune recommends the District People's Committee, the Department of Natural Resources and Environment and competent authorities to issue a decision to sanction the above administrative violation against Mr. Le Dinh Nam in accordance with the provisions of law.
On May 31, 2021, based on the provisions of law and the Minutes of Administrative Violation No. 03/BB-VPHC dated May 25, 2021 of the People's Committee of Nghia Hoi Commune, in Decision No. 1355/QD-XPVPHC, Mr. Vo Tien Sy - Chairman of the People's Committee of Nghia Dan District decided to impose an administrative penalty in the field of land against Mr. Le Dinh Nam; for committing the administrative violation of "Using land for perennial crops for non-agricultural purposes in rural areas without permission from a competent State agency". Mr. Le Dinh Nam was fined VND 6,500,000 by the Chairman of the People's Committee of Nghia Dan District; at the same time, he was forced to restore the original condition of the land before the violation.

Also related to“Green Stream Project”, it is known that the Department of Cyber Security and High-Tech Crime Prevention (Provincial Police) is currently coordinating with Nghia Dan District Police to investigate and verify organizations and individuals who posted information and advertised land plots for sale in the "Suoi Xanh project" on Facebook.
