From January 1, 2023, 4 laws will take effect, including: Law on Cinema; Law on Mobile Police; Law on Insurance Business; Law amending and supplementing a number of articles of the Law on Intellectual Property.

January 1, 2023 is approaching, and this is when four new laws will officially come into effect with many important changes.

Mobile police are allowed to carry weapons on planes

The Law on Mobile Police (CSCĐ) 2022 was passed by the National Assembly on June 14, 2022, replacing the CSCĐ Ordinance. The Law specifically stipulates the duties and powers of CSCĐ, identifying that CSCĐ mainly uses armed measures to combat riots and terrorism.

Copyright registration applications can be submitted via the public service portal.

The Law amending and supplementing a number of articles of the Law on Intellectual Property adds a form of submitting copyright registration applications to facilitate the process of carrying out registration procedures...

Accordingly, authors, copyright owners, and related rights owners can directly or authorize others to submit registration applications directly or via postal service or via the online public service portal to the state management agency for copyright and related rights.

Article 10 of the law stipulates 7 powers of the CSCĐ, including some new powers compared to the ordinance.

Specifically, CSCĐ will be allowed to bring weapons, explosives, support tools, vehicles, and technical equipment into airports and onto civil aircraft when fighting terrorism and rescuing hostages; suppressing subjects who commit dangerous acts using weapons and explosives; protecting the transport of special goods; CSCĐ will also be allowed to escort suspects and defendants who have committed particularly serious crimes; and use aircraft mobilized by competent authorities specifically for CSCĐ to promptly handle complicated security and order incidents.

In addition, CSCĐ is allowed to prevent and neutralize drones and ultralight aircraft that directly attack, threaten to attack or violate CSCĐ's protection targets within the no-fly zones and restricted-flight zones as prescribed by the Prime Minister.

Article 8 of the law stipulates more prohibited acts than the ordinance, such as: Bribery, bribery or coercion of CSCĐ officers and soldiers to act contrary to assigned duties and powers...

You have 21 days to opt out of purchased life insurance.

Starting from 2023, life and health insurance participants need to pay attention to some important regulations in the Law on Insurance Business 2022.

For example, for two types of life insurance (life insurance, human life) and health insurance, with contracts with a term of more than 1 year, within 21 days from the date of receiving the insurance contract, the insurance buyer has the right to refuse to continue participating in the insurance.

In that case, the insurance contract will be canceled, the insurance buyer will be refunded the premium paid after deducting reasonable expenses (if any) as agreed in the insurance contract; the insurance company does not have to compensate or pay insurance money when an insured event occurs.

The Law clearly distinguishes types of insurance contracts corresponding to types of insurance; clearly stipulates the insured objects and insured benefits for each type of insurance contract.

This Law also specifically stipulates that insurance enterprises, reinsurance enterprises, and foreign branches in Vietnam are not allowed to borrow to invest, entrust investment in securities, real estate business, or contribute capital to other enterprises.

At the same time, these enterprises are also not allowed to do real estate business, except in some cases such as purchasing, investing, and owning real estate to directly serve business activities...

2 cases where the movie must be stopped

The 2022 Cinema Law replaces the 2006 Cinema Law and the 2009 Law amending and supplementing a number of articles of the Cinema Law.

The 2022 Cinema Law adds provisions on stopping the dissemination of films for reasons of national defense, security, natural disasters, epidemics or emergency situations; or when there are violations of prohibited acts in cinema activities such as: Violating the Constitution and laws; inciting opposition or sabotage of the implementation of the Constitution and laws; inciting violence and criminal acts by showing in detail the implementation methods, images, sounds, dialogues, scenes of beatings, torture, etc.

The State agency with the authority to decide to stop the distribution of films is the agency that issues film classification licenses, the agency that receives notifications about the content and program of film screenings at public film screening locations, or the inspection agency as prescribed by the Government.

The decision to stop distributing a film will include the reasons, time and duration of the suspension of distribution. Organizations whose films are suspended must publicly announce this issue in the media and ensure the rights of related organizations and individuals.
