Mr. Nguyen Van Hoa, residing in Quy Hop district, asked: According to the 2024 Land Law, what types of land can be used for multiple purposes? What requirements must be met for the use of land for multiple purposes?

Reply:

Article 218,Land Law 2024 stipulates onmixed use landas follows:

1. The following types of land are used for multiple purposes:

a) Agricultural land is used in combination with commercial, service, livestock and medicinal plant cultivation purposes;

b) Land used for public purposes combined with commercial and service purposes;

c) Land for construction of public works is used in combination with commercial and service purposes;

d) Residential land used in combination with agricultural, commercial, service, and business-oriented public works;

d) Land with water surface is used for multiple purposes in accordance with the provisions of Articles 188, 189 and 215 of this Law;

e) Religious land and belief land used in combination with commercial and service purposes;

g) Land specified in Clause 2 and Clause 3, Article 9 of this Law shall be used for a combination of agricultural purposes, construction of postal, telecommunications, technology, information, outdoor advertising, and solar power infrastructure works.

2. The use of multi-purpose land must meet the following requirements:

a) Not to change the land type according to the land classification prescribed in Clause 2 and Clause 3, Article 9 and determined in the documents prescribed in Article 10 of this Law;

b) Does not eliminate the necessary conditions for returning to using the land for its main purpose;

c) Does not affect national defense and security;

d) Limit impacts on the conservation of natural ecosystems, biodiversity, and environmental landscapes;

d) Does not affect the land use of adjacent plots;

e) Fully perform financial obligations as prescribed;

g) Comply with relevant laws.

3. In case a public service unit uses land to build a service facility combined with commerce and services, it must switch to land lease and pay annual land rent for that combined area.

4. In cases of land use combined with commerce and services as prescribed in Points a, b, c, d, dd and e, Clause 1 of this Article, a land use plan must be prepared and submitted to the competent authority for approval. The contents of the combined land use plan include:

a) Information about the land plot or land area in use: location, area, form of land use; land use term;

b) Area, purpose of combined land use, duration of combined land use;

c) Content meets requirements according to regulations of law on environmental protection and other relevant legal regulations.

5. The Government shall specify this in detail.
