Official land acquisition for Viet Nhat Vocational Training Center project
On May 24, 2024, the Provincial People's Committee issued Decision No. 171/QD-UBND to reclaim 2,887.0 m2 of educational facility land managed and used by Viet Nhat High-Quality Vocational Training Center in Quan Bau ward, Vinh city.

VIOLATION OF LAND LAW
The policy of the Provincial People's Committee on the recovery of land for educational and training facilities managed and used by the Viet Nhat High-Quality Vocational Training Center in Quan Bau Ward, Vinh City (leased by the Provincial People's Committee in Decision No. 599/QD-UBND.DC dated December 12, 2007) was reported by Nghe An Newspaper on May 9, 2024 in the article "Land for Viet Nhat Center project in Quan Bau ward (Vinh city) will be reclaimed.”.
Accordingly, from April 23, 2024, by Document No. 3186/UBND-CN, the Provincial People's Committee has a policy to reclaim 2,887.0 m2Land for educational and training facilities managed and used by the Viet Nhat High-Quality Vocational Training Center in Quan Bau Ward, Vinh City. To ensure land recovery in accordance with legal regulations, in Document No. 3186/UBND-CN, the Provincial People's Committee assigned the Department of Natural Resources and Environment to "preside over and coordinate with relevant units to advise and draft a decision for the Provincial People's Committee to recover land in accordance with current legal regulations".

In order to carry out the tasks assigned by the Provincial People's Committee, after reviewing and basing on the provisions of the 2013 Land Law; Decree No. 47/2014/ND-CP dated May 15, 2014 and Decree No. 01/2017/ND-CP dated January 6, 2017 of the Government, the Department of Natural Resources and Environment has the following opinion: "The Viet Nhat High-Quality Vocational Training Center is leased land by the Provincial People's Committee in Quan Bau Ward, Vinh City, Nghe An Province to carry outViet Nhat High Quality Vocational Training Center ProjectThe project is 24 months behind schedule compared to the schedule recorded in the investment project. The Provincial People's Committee has granted a 24-month extension of the land use schedule in Decision No. 5830/QD-UBND dated December 1, 2017, but after the extension period, the investor has not yet completed the construction of the project works according to the approved planning.
At the same time, the Department of Natural Resources and Environment requests the Provincial People's Committee to:
“1) Recover 2,887.0 m2Land for educational and training facilities in Quan Bau ward, Vinh city of Viet Nhat High Quality Vocational Training Center (The land plot was leased by the Provincial People's Committee in Decision No. 599/QD-UBND.DC dated December 12, 2007). The location and boundary of the recovered land are determined according to the Extract of Cadastral Map of land plot No. 836/BD.DC approved by the Department of Natural Resources and Environment on January 29, 2008.
Reason for revocation: The organization leased land by the State violated the land law (according to the provisions of Point i, Clause 1, Article 64 of the Land Law).

Pursuant to the provisions of law and the above proposal of the Department of Natural Resources and Environment, on May 24, 2024, the Provincial People's Committee issued Decision No. 171/QD-UBND to reclaim the land of the educational facility leased by the Viet Nhat High-Quality Vocational Training Center by the Provincial People's Committee in Decision No. 599/QD-UBND.DC dated December 12, 2007. The content of Decision No. 171/QD-UBND clearly states:
“Recovered 2,887.0 m2Land for educational and training facilities managed and used by the Viet Nhat High Quality Vocational Training Center in Quan Bau Ward, Vinh City (The land was leased by the Provincial People's Committee in Decision No. 599/QD-UBND.DC dated December 12, 2007). The location and boundary of the recovered land are determined according to the Extract of the Cadastral Map of land plot No. 836/BD.DC approved by the Department of Natural Resources and Environment on January 29, 2008. Reason for recovery: Due to violation of land law (according to the provisions of Point i, Clause 1, Article 64 of the Land Law)".

Also in Decision No. 171/QD-UBND, the Provincial People's Committee assigned the Viet Nhat High-Quality Vocational Training Center to return the Certificate of land use rights, house ownership rights and other assets attached to land, code AI 189702 dated February 28, 2008 (original) to the Provincial Land Registration Office.
At the same time, the Provincial People's Committee assigned the Provincial Land Fund Development Center to manage the above-mentioned recovered land plot area for effective exploitation and use in accordance with legal regulations. Assign the Department of Natural Resources and Environment to organize the handover of the above-mentioned land plot to the Provincial Land Fund Development Center for management and use in accordance with regulations; direct the Provincial Land Registration Office to update and correct the land database and cadastral records; revoke the Certificate of land use rights, house ownership rights and other assets attached to land code AI 189702 dated February 28, 2008 (original) issued by the Provincial People's Committee to the Viet Nhat High-Quality Vocational Training Center or notify that the Certificate is no longer legally valid in cases where the land user does not comply with the return of the Certificate...

WILL CONSIDER THE PROPOSAL FOR LAND USE OF THE FACILITY
During the process of learning about the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward (Vinh City), we heard the Party Committee and the Quan Bau Ward authorities express their wish that the Provincial People's Committee and related departments and branches consider reclaiming the land of the Viet Nhat High-Quality Vocational Training Center Project; and allow this land area to be used as the second facility of the primary school, creating favorable conditions for learning for future generations in the area.
Upon receiving Document No. 3186/UBND-CN dated April 23, 2024 of the Provincial People's Committee on the policy of land recovery for the Viet Nhat High-Quality Vocational Training Center Project, Chairman of the Ward People's Committee Tran Hoang Tuan said that the cadres and people of Quan Bau Ward were very excited with the policy of the Provincial People's Committee.
At the same time, he continued to reiterate that the school grounds of the primary school in the area did not ensure the area and location were not convenient for students to travel to and from school, to discuss that "the ward Party Committee and government will propose to the competent authority to consider using the land of the high-quality Viet Nhat Vocational Training Center project for educational purposes".

Discussing the wishes of the Quan Bau ward government with the Vice Chairman of the Vinh City People's Committee, Mr. Le Sy Chien said that after the Provincial People's Committee issued a decision to reclaim the land of the Viet Nhat High-Quality Vocational Training Center Project, the relevant agencies assigned with the task will need some time to carry out the land reclamation procedures, including handling the assets built on the land according to the provisions of law.
However, the Vice Chairman of Vinh City People's Committee recognized that the wish of Quan Bau Ward People's Committee is a matter worth considering.
Mr. Le Sy Chien added: “In my opinion, the use of land for public purposes should be prioritized, moreover, the use for educational purposes is also consistent with the planning. However, the People's Committee of Quan Bau Ward needs to review the current scale of school areas in the area to have data to compare with the standards and norms; coordinate with the Department of Education and Training and the school to review the population size to predict the number of students in the future..., to have a report and recommendation to the City People's Committee. Only then will the City People's Committee have a basis to report to the Provincial People's Committee and competent authorities...".
