Chairman of Thai Hoa Town dialogues with people about the case of 'caught in bamboo bushes during site clearance'

(Baonghean.vn) – On the morning of June 16, Chairman of Thai Hoa Town People's Committee, Mr. Hoang Phu Hien directly had a dialogue with Mr. Pham Xuan Thanh and Mrs. Nguyen Thi Tho, Dong Phu hamlet, Dong Hieu commune, Thai Hoa town about the work of clearing the land for Lang Me bridge, National Highway 48.

The project to upgrade and renovate Lang Me Bridge and Khe Son Bridge on National Highway 48 is part of the second Transport Sector Credit Project to renovate the national road network. In July 2016, Thai Hoa town carried out site clearance to assign Project Management Board 6, Ministry of Transport to upgrade and renovate these two bridges.

In particular, the upgrading and renovation of Lang Me bridge must be carried out to compensate and support 9 households in Dong Phu hamlet, Dong Hieu commune, including the family of Mr. Pham Xuan Thanh and Mrs. Nguyen Thi Tho whose property on the land is a bamboo bush. However, Mr. Thanh and Mrs. Tho do not agree with the compensation and support plan.

After implementing the procedures, the leaders of Thai Hoa town and Dong Hieu commune had a dialogue with the family to resolve the problems; thereby allowing the family to cut down, collect and return the land to the construction unit.

However, Mr. Thanh and Mrs. Tho's family did not comply. On March 16, 2017, the clearance of the National Highway 48 traffic safety corridor for bamboo bushes was carried out under the leadership of the functional sector of Thai Hoa town.

Therefore, the family of Mr. Pham Xuan Thanh and Ms. Nguyen Thi Tho has a complaint about the work of clearing the traffic safety corridor; the work of clearing the ground for the project: Upgrading and renovating Lang Me bridge, Khe Son bridge under the Transport Industry Credit Project to renovate the national road network for the second time.

The complaint requested a compensation plan and land support for the area from the center of National Highway 48 from 7.5 to 14.5 meters and the process of site clearance for the project to upgrade and renovate Lang Me Bridge and Khe Son Bridge (Lang Me Bridge section, Nghia Thuan Commune - Dong Hieu Commune), which is not in accordance with legal regulations.

At the dialogue, Mr. Duong Ngoc Trung - Chief Inspector of Thai Hoa town, head of the delegation verifying the complaint content, presented a report on the results of the inspection and verification.

The Inspector's conclusion clearly stated that the complaint about compensation and land support for the area from the center of National Highway 48 from 7.5 to 14.5m affected by the project is a false complaint.

Because compared with the provisions of Decree 203/HDBT dated December 21, 1982 of the Council of Ministers on promulgating regulations on road protection, specifically in Article 7 on the protection corridor of road traffic works and Guidance Document No. 816/QLGT dated May 16, 2005 of Nghe An Department of Transport: Before 1995, Road 48 had a traffic safety corridor calculated from the edge of the embankment and from the top edge of the cut road or from the outer edge of the longitudinal ditch or the top ditch of the road outwards 10 m on both sides, equivalent to 14.5 m from the center of Road 48.

Meanwhile, through verifying the origin and land use process of Mr. Pham Xuan Thanh and Ms. Nguyen Thi Tho's household, the location of the bamboo grove of this family is the stream land managed by the People's Committee of Dong Hieu commune and is within the range of 11-14.5 m from the center of National Highway 48, that is, within the limits of the traffic safety corridor.

Therefore, the project does not compensate or support land for the area calculated from the center of National Highway 48 from 7.5 - 14.5m according to the complaint.

Regarding the complaint about the implementation process of site clearance for the project to upgrade and renovate Lang Me bridge, Khe Son bridge, Lang Me bridge section, Nghia Thuan commune - Dong Hieu commune, which is not in accordance with legal regulations, the verification team concluded that this content is correct or incorrect.

The Inspector concluded: The complaint is correct that in the process of implementing the site clearance work, there are still some steps missing, and the procedural documents are not strict. In particular, the documents related to the site clearance work have not been fully sent to the relevant organizations and individuals; some meeting minutes to implement the project site clearance procedures have not been fully prepared.

For the family of Mr. Pham Xuan Thanh and Ms. Nguyen Thi Tho, the complaint conclusion clearly stated: At the time of approving the plan, the adjustment of the boundary markers and clearance boundaries at the land location the family was using had not been made, and the household had only signed the Field Trip Notebook of the inventory officer but had not signed the Measurement and Inventory File, which was not in accordance with regulations.

Regarding the content of Mr. Thanh and Ms. Tho's family's wrong complaint, the inspection conclusion clearly stated the reason: the site clearance work to implement the project of Upgrading and renovating Lang Me bridge, Khe Son bridge, Lang Me bridge section, Nghia Thuan commune - Dong Hieu commune was fully implemented according to the process, ensuring publicity and democracy.

For other households affected by the project, the adjustment of boundary markers and site clearance boundaries has been fully implemented, and 13/16 households have signed the Inventory Records, 11/12 households have signed the Area Summary Table, and 5/12 households have signed the Land Plot Cadastral Measurement Results in accordance with regulations.

At the dialogue, in the spirit of frankness, democracy, openness, transparency and openness, Mr. Hoang Phu Hien - Chairman of Thai Hoa Town People's Committee directly listened and had a dialogue with Mr. Thanh and Ms. Tho's family.

Accordingly, Ms. Nguyen Thi Tho requested Thai Hoa town to do some things such as: stop the demolition and enforcement of bamboo bushes because her family has not yet completed the procedures for land recovery, compensation for land and assets attached to the land; revoke and cancel two notices related to the clearance of the land her family uses and restore the original status of the land plot...

On behalf of the town leaders, Mr. Hoang Phu Hien directly apologized to Mr. Thanh and Mrs. Tho's families because in the process of implementing the site clearance work, there were still some missing steps, the procedures were not strict; the implementing officers did not fully explain and mobilize the people to know and understand the site clearance procedures.

The Chairman of the People's Committee of Thai Hoa town explained and clarified the grounds for determining the non-compensation and land support for the area from the center of National Highway 48 inward from 7.5 to 14.5 meters affected by the project that the family complained about.

Mr. Hien hopes that after the dialogue, Mr. Thanh and Mrs. Tho's families will share and support the site clearance work to implement the project, including Lang Me bridge, to ensure project progress, ensure traffic safety, for the common development of Thai Hoa town.

The Chairman of the People's Committee of Thai Hoa town emphasized: After the dialogue on May 16, Thai Hoa town will send a notice of conclusion to the family before June 20. If the family does not agree, they have the right to appeal to higher authorities. As for Thai Hoa town, they will continue to take steps according to the provisions of law to serve the site clearance for the contractor to construct.

Lang Me Bridge on Highway 48 is currently only 7m wide. After renovation, the bridge width will be 14m, which will help ensure safe traffic on Highway 48.
