Mr. Dang Van Ba ​​in Hung Loc ward, Vinh city requested to issue a new Certificate of land use rights for 2 plots of land that his family bought in Nghi Phong commune, Nghi Loc district in 1999 (now Vinh city), Nghe An province.

Accordingly, Mr. Dang Van Ba ​​received the transfer of land use rights from households and individuals whose land was allocated by Nghi Loc District People's Committee in 1999.

In which, the first plot has an area of ​​120 m², currently not yet granted a replacement. The competent authority determines that the land plot is granted in the correct location, correct area and meets the conditions for granting a replacement Certificate of Land Use Rights.

The authorities requested that he prepare a profile according to regulations and submit it to the Reception and Results Department of Vinh City People's Committee for settlement according to regulations.

The problem is that the second plot of land that he requested to change the Land Use Rights Certificate also has an area of ​​120 m2.², adjacent to the first plot of land mentioned above.

This land plot was granted a Certificate of Land Use Rights by Nghi Loc District People's Committee to two users, including Mr. Dang Van Ba's household (receiving the transfer from another household) and Mr. Hoang Manh Hong's household.

Through the review of the application for the Certificate of Land Use Rights and the origin and history of land use, Nghi Loc District People's Committee has granted a Certificate of Land Use Rights to Mr. Hoang Manh Hong in accordance with the location assigned by Nghi Loc District People's Committee.

The Certificate issued to Mr. Dang Van Ba ​​is not correct with the location of the land plot that Nghi Loc District People's Committee allocated land in 1999 and issued the Certificate to Mr. Nguyen Ba Ho (the first user of the land plot).

At the citizen reception session, after listening to citizens' opinions, leaders of Nghi Phong Commune People's Committee, Nghi Loc District, Vinh City and the Department of Agriculture and Environment, Chairman of Nghe An Provincial People's Committee Le Hong Vinh directed specific handling plans.

First of all, the Chairman of the Provincial People's Committee pointed out the responsibility of Nghi Loc District People's Committee in granting the Land Use Right Certificate to Mr. Dang Van Ba, which overlapped with the land plot also granted to Mr. Hoang Manh Hong's household, and emphasized that this is a lesson in State management of land.

On that basis, comrade Le Hong Vinh requested to handle the issue of wrongly issuing cover to Mr. Dang Van Ba ​​and to fulfill the related obligations of the State, ensuring citizens' rights.

Regarding the exact plot of land that should have been granted to Mr. Dang Van Ba's household in another location on the same land plot, currently encroached by neighbors more than 70cm wide when building a house, the Chairman of the Provincial People's Committee assigned the Nghi Phong Commune People's Committee and relevant local authorities to resolve the matter. The Department of Agriculture and Environment will guide the handling.

For citizens, the Chairman of the Provincial People's Committee requested Mr. Dang Van Ba ​​and related households to negotiate the exchange of land plots to suit the reality. The local government plays an intermediary role, supporting the negotiation process.

Also at the citizen reception session, Chairman of Nghe An Provincial People's Committee Le Hong Vinh assigned the Provincial Citizen Reception Committee to review and urge the implementation of the conclusions of the Provincial People's Committee Chairman at previous citizen reception sessions, ensuring progress.
