Spread the movement at the grassroots level

Deploying the plan to build the model of "Publicity, integrity, transparency - Peaceful unit" at the Provincial Civil Judgment Enforcement Department and its affiliated units, Comrade Vi Van Nhung - Deputy Director of the Provincial Civil Judgment Enforcement Department said that, on the basis of the model of Self-management Team on security and order in coordination with the police force, the affiliated units continue to promote to build the model of "Publicity, integrity, transparency - Peaceful unit" to further spread the movement "All people protect national security" in localities and units.

The model aims to actively propagate people to comply with rules and regulations, practice a civilized lifestyle; Manage and educate cadres and civil servants to perform their duties well, participate in preventing, detecting and denouncing crimes; build close, unified and united relationships to strictly implement civil judgment enforcement. Lieutenant Colonel Nguyen Thanh Vinh - Deputy Head of Department PA03, Provincial Police, speaking at the conference, highly appreciated the coordination between the enforcement forces at all levels and the police in building the movement "All people protect national security". The implementation of the model "Publicity, integrity, transparency - Peaceful units" by civil enforcement agencies will effectively contribute to improving the quality of the movement in the unit as well as the locality. The police force will continue to coordinate to further improve the effectiveness of the model.

Deploying the task of executing the judgment

After launching the model "Publicity, integrity, transparency - Peaceful unit", the Provincial Civil Judgment Enforcement Department deployed an assessment of the work implementation situation in 2022 and deployed key tasks in the first quarter of 2023.

In 2022, although the enforcement of civil judgments and monitoring of administrative judgments in Nghe An faced many difficulties due to objective and subjective factors, with the synchronous and drastic implementation of many solutions and the efforts of the enforcement agencies, many high results were achieved, especially in terms of work and money, reaching and exceeding targets. Specifically, a total of 20,559 cases had to be enforced, of which 15,318 were newly accepted in the year; 15,059 cases/17,649 cases with conditions for enforcement were completed, reaching 85.32% (exceeding the assigned target by 3.32%).

Regarding money: Total amount to be executed is 1,968.7 billion VND, of which 648.5 billion VND was newly accepted in the year (not including 45,464,129 VND entrusted). Execution results were over 535 billion VND/1,117.8 billion VND with conditions for execution, reaching 47.88% (exceeding 7.28% of the assigned target).

Compared to 2021, in 2022, 1,870 more tasks were completed (equivalent to 14%), and 60,819,240,000 VND higher (equivalent to 13%). Compared to the work and money targets assigned in 2022: 22/22 units completed 02 targets.

Regarding the target of "Ensuring verification of conditions for execution, accurately and legally classifying civil judgment enforcement with and without conditions for execution; promptly, fully and in accordance with regulations posting information on judgment debtors who do not have conditions for execution and information related to the selection of valuation organizations and asset auctions on the Civil Judgment Enforcement Portal/Website, Asset Auction Portal; posting full information on administrative judgment enforcement according to regulations" basically meets the requirements. Accordingly, there are 17,649 cases with conditions for execution, accounting for 86%; 2,910 cases without conditions for execution and postponement or temporary suspension of judgment enforcement, accounting for 14%. Regarding money, there are more than 1,117.8 billion VND with conditions for execution, accounting for 57%; 850 billion VND has not been implemented yet and has been postponed or temporarily suspended, accounting for 43% of the total amount to be implemented.

The conference also recognized the limitations and shortcomings, identified the causes to have solutions to overcome and improve the effectiveness of the enforcement work. In particular, there are a number of causes that need to affect the effectiveness of the enforcement work such as: Due to the impact of the Covid-19 epidemic, the progress is slowed down due to the need to limit contact. Cases related to credit and banking judgments with large amounts of money (accounting for 52.3% in terms of money compared to the total amount of work and money to be enforced) mostly face difficulties in organizing the enforcement of judgments due to the fact that the status of mortgaged and secured assets is different between the records and the field; the actual value of the assets is much smaller than the security obligation; some assets of a assembled nature are replaced with machinery and equipment (fishing boats); Some vehicles are hidden by the judgment debtor and the person with the secured assets and cannot be traced... Some judgments declare many assets as security for one obligation, causing difficulties in handling and paying money in the enforcement of judgments.

Many cases have had their assets seized and put up for auction multiple times, many of which have been auctioned 3-5 times, and some cases have been auctioned over 18 times but still have not been sold. Up to now, 28 cases/87.9 billion VND have not been auctioned.

Corruption and economic cases have increased sharply (in 2022, the enforcement agencies in the province have accepted 233 new cases, equivalent to nearly 76 billion VND), especially cases related to usury in civil transactions (the enforcement agencies have accepted 211 cases/25.8 billion VND). The situation of borrowing and defaulting on savings and credit associations in some localities in the province continues to increase, with complicated developments involving many related subjects; the number of cases requiring enforcement of fines and arrears in gambling and lottery cases has increased sharply, especially cases related to lottery with huge arrears, but most of the subjects are serving prison sentences, have no income or assets...

To overcome shortcomings and limitations, and successfully complete the tasks in 2023, many delegates discussed and proposed solutions in building directions and work contents to carry out assigned tasks. The conference agreed that the two-level enforcement agencies need to grasp the situation and results of civil and administrative enforcement, especially the difficulties and problems that arise; regularly follow local Party committees and authorities and seek the consensus and support of relevant agencies, departments and branches to propose and recommend timely and effective handling, especially in directing the resolution of major and key cases, complicated and prolonged complaints and denunciations, as well as in personnel work, funding, planning, land allocation for headquarters construction, etc.

Proactively review the inter-sectoral coordination regulations signed by the two sectors. If any inappropriateness or incomplete adjustment of relationships in the enforcement of civil and administrative judgments is found, propose amendments and supplements accordingly, in order to strengthen coordination and improve the quality and effectiveness of work.

Monthly, the Provincial Civil Judgment Enforcement Department will notify the results of civil judgment enforcement and monitor administrative judgment enforcement to the Chairmen of the People's Committees of districts, cities and towns under the direction of the General Director to coordinate in assessing and directing the work of civil judgment enforcement and monitoring administrative judgment enforcement of localities in the province./.
