Dien Chau strives to clear land for the project to renovate and upgrade National Highway 7
(Baonghean.vn) - Dien Chau district is actively carrying out site clearance for the project to renovate and upgrade National Highway 7, section Km0 - Km36, and to handle landslides caused by storms and floods in the Khe Thoi - Nam Can section (section through Dien Chau district).
The project was approved by the Ministry of Transport in Decision No. 333/QD-BGTVT dated March 18, 2022. Currently, the project still has many difficulties and problems.
Project implementation and progress
The project to renovate and upgrade National Highway 7, section Km0 - Km36, and handle landslides caused by storms and floods in the Khe Thoi - Nam Can section, Nghe An province (Project to renovate and upgrade National Highway 7, section through Dien Chau district) was approved by the Ministry of Transport in Decision No. 333/QD-BGTVT dated March 18, 2022.

Section through the areaDien Chau districtThe project is located on the route from Km0+00 - Km9+180, with a total length of 9.18 km, passing through Dien Chau town and the communes of Dien Thanh, Dien Phuc, Dien Cat and Minh Chau (Dien Chau town does not have to reclaim land because the scope of GPMB markers does not affect the land plots of households and individuals). The total number of land plots affected by the project is 867, of which 360 are residential land, 397 are agricultural land and 110 are other land (including: Traffic land, irrigation land, non-agricultural land other than residential land, unused land, ...). The total number of residential land plots recovered and required to be allocated new residential land (TDC) is 15 plots (in Dien Phuc commune).

As of July 24, 2023, Dien Chau district has handed over the discontinuous sections from Km0+00 - Km9+180 (left and right of the route) with a total length of 11.33 km/18.36 km (62%). The handed over length includes all agricultural land plots along the route, land managed by the People's Committees of communes, road traffic safety corridor land and land recovered by previous projects. The remaining unhanded over land (including left and right of the route) is 7.032 km of residential land, garden land and residential land plots of households along the route, of which: Dien Thanh commune 66/66 households have not agreed to sign the documents; Dien Phuc commune 97/104 households have signed; Dien Cat commune 90/120 households have signed and Minh Chau commune 68/70 households have signed the documents.

Mr. Le Manh Hien - Vice Chairman of Dien Chau District People's Committee said: The majority of households along the route basically agree with the policy of reclaiming land and assets on the land to implement the project. However, some households still have complaints requesting compensation and support for the land area from the foot of the old Highway 7 according to previous land allocation documents through the periods; some households in Dien Cat and Minh Chau communes complained that the State still undercompensated when reclaiming land to implement the Dau Bridge construction project, Dien Cat commune in the period of 2005-2007; the previous National Highway 7 renovation and upgrading project in the period of 2009-2012... The district has received and specifically studied the complaints and recommendations of the people to implement them in accordance with the provisions of law.

To ensure the legitimate and legal rights and interests of affected people, limit prolonged complaints, promptly hand over the project construction site on schedule according to the direction of the Provincial Party Committee and the Provincial People's Committee, the People's Committee of Dien Chau district has sent a report to the Chairman of the Provincial People's Committee for consideration, directing relevant departments and branches, and the district also proposed solutions to resolve the above problems as follows:
For cases of land previously allocated from the foot of old Highway 7 (the entire route in Dien Chau district, most of the land allocated on the traffic safety corridor is garden land, except for cases of land allocation before 1980), the District People's Committee has issued a document requesting the Road Management Area II - Vietnam Road Administration to issue a document to determine and restore the boundary of the foot of old Highway 7 as a basis for adjusting the measurement of technical records of land plots for compensation and support as per the policy applied for land acquisition and compensation for the National Highway 1A renovation and upgrading project in the 2012 - 2014 period and using the current land acquisition and compensation source for the National Highway 7A renovation and upgrading project for payment.

For the land area of households affected by the Dau Bridge Construction Project (phase 2005-2007) and the National Highway 7 Renovation and Upgrading Project (phase 2009-2012) that had their land previously recovered, but the compensation and support policies for site clearance at the time of land recovery were not adequate (insufficient compensation and support): Compensation and support for the area previously recovered for garden land, but not yet compensated, or only compensated for agricultural land and residential land plots (garden land) according to the provisions of Clause 3, Article 27 of Decision No. 24/2022/QD-UBND dated February 14, 2022 of the Provincial People's Committee will be provided. The land area considered for compensation and support for households is determined according to the land acquisition records of old projects (Dau Bridge Project and the former National Highway 7 Renovation and Upgrading Project in the period of 2009-2012) and according to the land acquisition decisions issued by the District People's Committee at the previous time. The District proposes to use the land acquisition source of the current National Highway 7A Renovation and Upgrading Project for payment.
Resolutely speed up progress
The project to renovate and upgrade National Highway 7, section Km0-Km36, and handle landslides caused by storms and floods in the Khe Thoi - Nam Can section (section through Dien Chau district) is a key traffic project in the province. According to the assigned schedule, the package belonging to the section Km0 - Km5 must be completed before August 10, 2023 to connect with the interchange of the North-South expressway, expected to be technically opened to traffic on September 2, 2023, as directed by the Prime Minister.

To ensure the right progress, in the coming time, the People's Committee of Dien Chau district will continue to focus on mobilizing the entire political system from the district to the commune level to vigorously propagate and mobilize people to understand the importance of the project; comply with compensation, support and resettlement policies according to State regulations. Focus maximum time on directing departments, civil servants, and related localities to urgently complete assigned tasks, hand over the site to the investor to ensure compliance with requirements before August 10, 2023 under the direction of the Provincial Party Committee and the Provincial People's Committee.
The District People's Committee directs specialized departments to build, consolidate, and complete legal documents to handle violations of related organizations and individuals (if any). In cases where all processes and procedures have been fully implemented in accordance with the provisions of law but citizens do not comply, have acts of resistance, or obstruct the construction unit, the organization shall enforce or protect the construction according to regulations.
Focus on reviewing existing problems, difficulties, complaints and recommendations from households along the route, promptly handling and resolving them according to authority and according to the policy documents of the Provincial People's Committee (for matters beyond the authority of the district). Have appropriate solutions to speed up the inventory, counting, appraisal and approval of the land acquisition plan for the remaining cases. In the immediate future, priority will be given to completing the Km0 - Km5 section.

Direct departments, branches, People's Committees of communes and related agencies and units to enhance their responsibility in coordination and implementation; focus on resolving citizens' petitions and complaints promptly, effectively and in accordance with the law. Focus on directing the construction and completion of resettlement areas as soon as possible to serve as a basis for land allocation and resettlement arrangements for households that have to relocate and soon stabilize their lives. Agree on plans, propagate and mobilize households eligible for resettlement to hand over the site in advance for timely project implementation. Continue to work with road management agencies and related units to collect and compile legal documents to determine traffic safety corridors through periods, fully showing the corridor boundaries on technical measurements of land plots (corridor boundaries according to Decree 203, Decree 11...), restore the foot of old Road 7 to serve as a basis for considering the implementation of compensation and support policies, according to regulations.
For households whose land was affected in the Dau bridge area (Dien Cat commune) in the period of 2005-2007; The project to renovate and upgrade National Highway 7 (period 2009-2012) had previously had their land recovered, but the compensation and support policies for site clearance at the time of land recovery were not adequate (compensation and support were lacking)... After receiving the official policy document from the Provincial People's Committee, the District People's Committee will assign specialized departments, branches, and People's Committees of relevant communes to implement.

Dien Chau District also requested the Vietnam Road Administration to direct the Road Management Area II to facilitate and support the district in collecting documents to restore traffic boundaries and corridor boundaries in a timely and complete manner. Consider and promptly resolve the district's recommendations on connection points between National Highway 7 and district roads that are preparing to be upgraded and renovated, and points that need design adjustments to suit the actual situation of the locality. Request Project Management Board 4 to strengthen coordination with the District People's Committee and the Project Compensation Council to more effectively implement compensation work to ensure progress; At the same time, direct construction units to concentrate machinery, equipment, human resources and material resources to complete the construction within the locality where the site has been handed over. For sections that have been constructed, it is necessary to promptly complete the road surface to avoid dust, affecting the lives and activities of the people. In particular, pay attention to construction sites through residential areas and construction sections on both sides of the route./.
