Land price, authority to decide land price according to Land Law 2024
Mr. NQC in Quy Hop district asked: How are land prices and the authority to decide on land prices regulated under the 2024 Land Law?
Article 160 of the 2024 Land Law stipulates:
1. Specific land prices are applied in the following cases:
a) Calculating land use fees for organizations when the State allocates land with land use fee collection without auctioning land use rights, without bidding to select investors to implement projects using land, allocates land with land use fee collection to winning investors or economic organizations established by winning investors to implement projects using land, recognizes land use rights, allows change of land use purpose but must pay land use fees;
b) Calculating land rent when the State leases land and collects land rent once for the entire lease term, except in cases through auction of land use rights;
c) Calculating the value of land use rights when equitizing state-owned enterprises according to the provisions of law on equitization;
d) Determine the starting price for auctioning land use rights when the State allocates or leases land, except for the case specified in Point i, Clause 1, Article 159 of this Law;
d) Calculating land use fees and land rent when extending land use, adjusting land use duration, adjusting detailed construction planning; allowing change of land use form;
e) Calculating compensation when the State reclaims land.

2. The authority to decide on specific land prices is stipulated as follows:
a) The Chairman of the Provincial People's Committee decides on specific land prices in cases of land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for auction of land use rights, determination of land use right value when equitizing enterprises under the authority of the Provincial People's Committee according to the provisions of this Law;
b) The Chairman of the District People's Committee decides on specific land prices in cases of land allocation, land lease, permission to change land use purpose, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, and determination of starting price for auction of land use rights under the authority of the District People's Committee according to the provisions of this Law.
3. The agency with the function of land management is responsible for assisting the Chairman of the People's Committee at the same level in organizing the determination of specific land prices. During the implementation process, the agency with the function of land management is allowed to hire a land price consultancy organization to determine specific land prices.
4. For areas where there is a land price list for each plot of land based on the value area and standard plot of land, the specific land price is determined according to the land price list at the time of land valuation.
5. The Government shall detail this Article.
