Proposal to completely handle the case of illegal construction of a 'huge' structure on forestry land in Thanh Chuong

Here, in addition to acknowledging the achieved results, the Supervisory Delegation of the People's Council of Thanh Chuong district pointed out that the implementation of the law on handling administrative violations in the land sector still has many limitations; the results of handling violations are still low; the process of handling and sanctioning administrative violations is not yet guaranteed...

The Supervisory Delegation of the People's Council of Thanh Chuong district recommended that the District People's Committee direct the People's Committees of communes to review and thoroughly handle administrative violations in the land sector; in addition to handling and imposing administrative penalties, it is necessary to pay attention to implementing measures to overcome the consequences of violations; direct relevant functional forces, departments, offices and agencies to strengthen coordination with the People's Committees of communes to handle administrative violations in the land sector.

At the same time, it is requested that the District People's Committee thoroughly handle the case of administrative violations in the land sector for which a Decision on administrative sanctions has been issued by the District People's Committee (the administrative violation of land by Mr. Cao Trong Hong in Thanh Mai commune) to demonstrate the strictness of the law and set an example for other subjects.

Regarding Mr. Cao Trong Hong's illegal construction on forestry land, through inspectionThanh Chuong District People's Committeedetermined that in November 2017, Thanh Chuong District People's Committee affirmed that Mr. Cao Trong Hong had arbitrarily changed the land use purpose without permission from the competent state agency; hiring excavators to level the ground, gather materials, build houses and livestock barns... is an administrative violation in the land sector.

Pursuant to the provisions of law, from January 30, 2019, Thanh Chuong District People's Committee issued Decision 529/QD-XPVPHC to administratively fine Mr. Cao Trong Hong with the amount of 22,500,000 VND. At the same time, he was required to restore the land status before the violation which was changed due to the administrative violation. Specifically, to dismantle and clear all illegally built houses and livestock barns and restore the status of production forest land at plot No. 523, map sheet No. 2 of the forestry map, in Khe Nai forest area, Trung Son hamlet, Thanh Mai commune.

However, Mr. Cao Trong Hong did not comply with the demolition and clearance of the illegally built house and livestock barn. This is the reason why the Thanh Chuong District People's Council requested the District People's Committee to thoroughly handle the case to demonstrate the strictness of the law and set an example for other subjects.

It is known that on December 17, 2020, the 14th session of the 19th term of the District People's Council took place in Thanh Chuong district. Here, the District People's Council delegates questioned the content of administrative sanctions for violations in the land sector, in which they requested the District People's Committee to thoroughly handle the violations of Mr. Cao Trong Hong.

Responding to questions, the representative of Thanh Chuong District People's Committee reported on the situation of administrative violations in the field of land in the area, clarifying the causes, responsibilities and solutions to be implemented in the coming time.

Regarding the remaining violations in the area, the People's Committee of Thanh Chuong district determined that there are still 5 cases that have not been completely handled, including: Ms. Nguyen Thi Huong, Thuy Son village, Thanh Thuy commune; Mr. Lo Van On, Thanh Yen village, Thanh Son commune; Mr. Cao Trong Hong, Tay Ho 1 block, Quang Tien ward, Thai Hoa town; Mr. Nguyen Canh Ty, Thanh Cao village, Dai Dong commune; Mr. Nguyen Ba Suu, Thanh Cao village, Thanh Duong commune.

Regarding Mr. Cao Trong Hong's violation, Thanh Chuong District People's Committee informed the district People's Council delegates that it is currently directing specialized departments to develop enforcement measures to implement enforcement according to regulations.
