(Baonghean.vn) - The People's Committee of Yen Thanh district has just organized a dialogue with people of Cong Thanh commune to clarify issues related to compensation and site clearance (GPMB) when implementing the Project to Upgrade National Highway 7, section Km0 - Km36 and handling landslides caused by storms and floods in the Khe Thoi - Nam Can section.

Project to upgrade National Highway 7, section Km0 - Km36 and handle landslides caused by storms and floods, section Khe Thoi - Nam Can, Nghe An provinceThe Investment Policy was approved in Decision No. 1338/QD-BGTVT dated July 20, 2021 with a total investment of VND 1,300 billion, with Project Management Board 4 as the investor. This is the second project in the medium-term public investment plan for the period 2021 - 2025 approved by the Ministry of Transport.

This project is implemented to gradually complete the traffic infrastructure of National Highway 7 according to the plan; contribute to strengthening connectivity, improving exploitation capacity, ensuring smooth traffic on the transport corridor from Nam Can border gate to the coastal provinces of the Central region. In particular, the project connects the North - South expressway at the National Highway 7 intersection in Dien Chau district with localities along National Highway 7 and with Laos; at the same time, effectively promote previously invested sections; create conditions to support local socio-economic development, ensuring regional defense and security.

In Yen Thanh district, the project passes through 5 communes: Vinh Thanh, Vien Thanh, Bao Thanh, Cong Thanh, My Thanh with a length of about 27km. To implement the project, the Compensation Council of Yen Thanh district has developed a compensation plan, supported land acquisition for affected subjects in the communes, and has publicly collected opinions and carried out payment procedures in some localities.

Although the deadline has come to complete the handover of the clean site for the construction units to urgently carry out, in Cong Thanh commune with 4.7km of National Highway 7 passing through, there are still many households that have not agreed on the compensation plan for land acquisition and clearance; some households, although having received support money and compensation for land acquisition and clearance, continue to have petitions.

Ms. Truong Thi Thang - Hamlet 2, Cong Thanh Commune reported that her family was offered a compensation plan of nearly 48 million VND by the District Compensation Council. However, compared to the family next door, although Ms. Thang's family was more affected, they received less compensation, even though her family's land was from 1989. Meanwhile, the family next door, who came to live in 1992, received more than 100 million VND in compensation. Believing it was unfair, Ms. Thang's family has not received compensation and has not yet dismantled the construction.

Mr. Bui Huu Hong, also residing in Hamlet 2, Cong Thanh Commune, bought land in 1989, was granted a "green book" in 1990 and a red book in 1995. However, when implementing land clearance to implement the Project to Upgrade National Highway 7, section Km0 - Km36 and handle landslides caused by storms and floods in the Khe Thoi - Nam Can section, Mr. Hong reported that his family did not receive any notice. At the same time, through the compensation plan that the households received, there was an unfairness, there were households that moved in later but were compensated more money.

Some households also requested to increase the compensation and support levels for housing items, kiosks, corrugated iron roofs, cement yards, walls, etc. Some households are not eligible for compensation and support, but because they have illegal constructions on the traffic corridor, they are requested to be compensated for the structures and supported with demolition costs...

Many households also expressed their opinions that since 1989, when households bought land along National Highway 7, they all went through the Commune People's Committee. However, when verifying, the Compensation Council for Land Acquisition and Site Clearance said that the commune sold without authority and only compensated and supported 50% of the compensation value.

In addition, some households that have received support and compensation and have handed over their premises also requested additional support when having to dismantle the rolling door system, plaster ceiling... because these assets cannot be reused if dismantled.

Urgently expedite site clearance to hand over to the construction unit

According to the report of the Compensation Council of Yen Thanh district, the people's petitions have been answered in writing. At the same time, the People's Committee of Yen Thanh district also sent a document to the Provincial People's Committee to ask for opinions on some petitions, but because many households did not agree, this dialogue session was organized.

Regarding the opinions of some households who questioned the purchase of land and moved out since 1989 but were not compensated, the representative of the Compensation Council for Land Acquisition and Site Clearance replied that in some cases, people were assigned land by the Commune People's Committee without their authority. After that, some land plots were deducted from the road space when the Land Use Right Certificate was issued, and people did not fulfill their financial obligations in this area, so they were not compensated.

Regarding the proposal to have a mechanism to support the dismantling labor for families to hire workers to dismantle, the representative of the Compensation Council for Land Acquisition and Site Clearance of Yen Thanh District also replied that, based on the provisions of current law, construction works after July 1, 2004 on land that does not meet the conditions for land compensation have no provisions on support for dismantling labor.

Previously, on January 9, 2024, after receiving an official dispatch from the People's Committee of Yen Thanh district on the progress of site clearance when implementing the Project to Upgrade National Highway 7, section Km0 - Km36 and handling landslides caused by storms and floods in the Khe Thoi - Nam Can section, especially the people's recommendations related to compensation policy, the Department of Natural Resources and Environment issued Document No. 186/STNMT-QLDD on difficulties in site clearance compensation for the Project to Upgrade National Highway 7A through Yen Thanh district.

Accordingly, the Department of Natural Resources and Environment requested the People's Committee of Yen Thanh district to check and review each file for land used before December 18, 1980, which has a part of the road that must be recovered. In case of stable land use, no compensation over the periods and complete records, compensation, support and resettlement will be considered when the State recovers land to implement the project according to regulations.

At the same time, check and review the current status of land use, origin, and implementation of financial obligations for cases related to illegal land sales before July 1, 2004. For cases with guaranteed records, the District People's Committee shall propose other support and submit to the Provincial People's Committee for approval.

At the dialogue, on behalf of the leaders of Yen Thanh district, Mr. Nguyen Van Duong - Vice Chairman of the District People's Committee, Chairman of the Project Compensation Council acknowledged cases where households proactively dismantled architectural structures to hand over the site to the construction unit.

For other eligible cases that the Provincial People's Committee has allowed, the district will synthesize and review to ensure the rights of the people. However, it is important that people also voluntarily dismantle to hand over the site to the construction unit soon. If any household still insists on not dismantling to hand over the site, the district will have a plan to protect the construction, ensuring the schedule is met.
