Consulting people about land use planning is a mandatory step in the process of making land use planning. So how is consulting people about land use planning and plans regulated?. The issue of concern of Ms. Tran Hai Yen (Do Luong, Nghe An).

Reply: Article 70 of the 2024 Land Law stipulates the collection of opinions on land use planning and plans as follows:

1. Consulting on national land use planning, national defense land use planning, and security land use planning shall comply with the provisions of law on planning.

2. The consultation on provincial land use planning is regulated as follows:

a) The provincial land use planning agency is responsible for collecting opinions from relevant departments, branches, the provincial Vietnam Fatherland Front Committee, the district People's Committee, relevant agencies, organizations, communities, and individuals on land use planning. The collection of opinions is carried out through the form of public disclosure of information on the content of the land use planning on the website of the provincial land use planning agency. The contents of the collection of opinions include an explanatory report and a map system on land use planning;

b) The synthesis, reception, explanation of opinions and completion of the land use planning plan must be carried out before submitting it to the Land Use Planning Appraisal Council and the comments and reception and explanation of comments must be publicly announced on the website of the provincial land use planning agency;

c) The time for collecting opinions on provincial land use planning is 45 days from the date of public disclosure of information on the content of the consultation.

3. The consultation on district-level land use planning and annual district-level land use plans is regulated as follows:

a) The district-level land use planning agency shall consult relevant departments, agencies, sectors, the Vietnam Fatherland Front Committee at the district level, the People's Committee at the commune level, relevant agencies, organizations, residential communities and individuals on land use planning and plans. The consultation shall be carried out through the form of public disclosure of information on the content of land use planning and plans on the electronic information page of the district-level land use planning agency, the People's Committee at the commune level and public posting at the headquarters of the People's Committee at the commune level, residential areas, posting and displaying at the cultural houses of villages, hamlets, hamlets, villages, hamlets, villages, hamlets, villages, hamlets, and residential groups, organizing conferences and seminars and distributing questionnaires to households and individuals representing communes, wards and towns. The consultation shall include an explanatory report and a map system on land use planning;

c) The time for collecting opinions on district-level land use planning is 30 days, and on district-level annual land use plans is 20 days from the date of public disclosure of information on the content of the consultation.

4. Opinions on land use planning and plans must be fully and accurately synthesized and must be received and explained objectively, transparently, seriously and thoroughly.
