What is the penalty for forgetting to bring your driver's license when driving?

Not carrying registration papers and driver's license is a common mistake of many traffic participants.

Many people participating in traffic often make some mistakes related to driving licenses, such as not carrying vehicle registration when driving a car or motorbike, as well as not having a driving license. In such cases, how will violators who do not carry vehicle registration be punished?

According to the provisions of Decree No. 46/2016/ND-CP regulating administrative sanctions in the field of road and railway traffic, it is stipulated that:

Article 21. Penalties for violations of regulations on conditions for motor vehicle drivers

2. A fine of VND 80,000 to VND 120,000 shall be imposed for one of the following violations:

a) Drivers of motorbikes, mopeds, and vehicles similar to motorbikes and vehicles similar to mopeds do not have or do not carry a valid Certificate of civil liability insurance of motor vehicle owners;

b) Drivers of motorcycles, mopeds, vehicles similar to motorcycles and vehicles similar to mopeds do not carry the Vehicle Registration Certificate;

c) Drivers of motorcycles and similar vehicles do not carry a driving license, except for violations specified in Point b Clause 5, Point c Clause 7 of this Article.

3. A fine of VND 200,000 to VND 400,000 shall be imposed for one of the following violations:

a) Drivers of automobiles, tractors and vehicles similar to automobiles do not carry a driving license, except for violations specified in Point c Clause 7 of this Article;

b) Drivers of automobiles, tractors and vehicles similar to automobiles do not carry the Vehicle Registration Certificate;

c) Drivers of automobiles, tractors and vehicles similar to automobiles do not carry a Certificate of technical safety and environmental protection inspection (for vehicles that are required to be inspected).

5. A fine of VND 800,000 to VND 1,200,000 shall be imposed on drivers of motorcycles with a cylinder capacity of less than 175 cm3 and similar vehicles committing one of the following violations:

a) Not having a driving license or using a driving license not issued by a competent authority, or an erased driving license.

7. A fine of VND 4,000,000 to VND 6,000,000 shall be imposed on drivers of motorbikes with a cylinder capacity of 175 cm3 or more, cars, tractors and vehicles similar to cars who commit one of the following acts:

a) Having a driving license that is not suitable for the type of vehicle being driven or has expired for 06 (six) months or more;

b) Not having a driving license or using a driving license not issued by a competent authority, or an erased driving license.

In fact, at the time when the traffic police check the violator without vehicle registration, they are forced to confiscate the driver's license. If the violator cannot present both of the above documents, the traffic police are forced to temporarily detain the vehicle to ensure payment of the fine and to prove the origin of the vehicle later.
