The National Assembly 'finalized' the end of the operation of district-level administrative units nationwide from July 1, 2025.

On the morning of June 16, at the 9th Session, the 15th National Assembly passed the Resolution on Amending and Supplementing a Number of Articles of the Constitution of the Socialist Republic of Vietnam with 470/470 delegates attending the meeting in favor.

After receiving and revising, the draft Resolution submitted to the National Assembly for approval has 2 articles, of which Article 1 amends and supplements 5 articles and clauses of the current Constitution (including Article 9, Article 10, Clause 1 of Article 84, Article 110 and Article 111).

Article 2 stipulates the effective date of the Resolution, the end of operations of district-level administrative units and transitional provisions (reviewed, absorbed and revised to specify Conclusions No. 150-KL/TW, No. 163-KL/TW and No. 167-KL/TW of the Politburo and Secretariat).

After the Resolution amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam and the Law on Organization of Local Government (amended) was passed by the National Assembly, the Standing Committee of the National Assembly issued 34 resolutions on the arrangement of commune-level administrative units together with Resolution No. 202/2025/QH15 of the National Assembly on the arrangement of provincial-level administrative units, which will create a complete and synchronous legal basis, ensuring that all administrative units across the country uniformly implement the 2-level local government model and administrative units formed after the arrangement will officially operate from July 1, 2025.

The amendment stipulates: The administrative units of the Socialist Republic of Vietnam are organized into two levels, including provinces and centrally run cities and administrative units below provinces and centrally run cities as prescribed by law. Special administrative-economic units are established by the National Assembly.

The establishment, dissolution, merger, division, and adjustment of administrative boundaries must consult local people and follow the order and procedures prescribed by the National Assembly.

Local government is organized in administrative units of the Socialist Republic of Vietnam, including People's Councils and People's Committees organized in administrative units suitable to the characteristics of rural, urban, and island areas as prescribed by the National Assembly.

Local authorities in special administrative-economic units are prescribed by the National Assembly when establishing such special administrative-economic units.

This Resolution takes effect from the date of its adoption. The operation of district-level administrative units nationwide will end from July 1, 2025.

The Resolution also stipulates: When perfecting the organizational apparatus of agencies after implementing the administrative unit arrangement and ending the operation of district-level administrative units in 2025, the election of the positions of Chairman, Vice Chairman of the People's Council, Head of the People's Council Committees, Chairman, Vice Chairman, and member of the People's Committee in the administrative unit formed after the arrangement shall not be conducted; the Head and Deputy Head of the National Assembly Delegation of provinces and centrally run cities formed after the arrangement shall not be elected.

Based on the announcement of the Party Committee with authority to manage cadres, the Standing Committee of the National Assembly appoints the Chairman, Vice Chairman of the People's Council, Heads of the People's Council Committees, Heads and Vice Heads of the National Assembly Delegation in the provinces and centrally run cities formed after the rearrangement; the Prime Minister appoints the Chairman and Vice Chairman of the People's Committee in the provinces and centrally run cities formed after the rearrangement.

The Standing Committee of the People's Council of a province or centrally-run city shall appoint members of the People's Committee of the same level and appoint the Chairman, Vice Chairman of the People's Council, Heads of Committees of the People's Council, Chairman and Vice Chairman of the People's Committee of the lower-level administrative unit formed after the reorganization.

The Standing Committee of the People's Council in the administrative unit below the province or centrally-run city formed after the arrangement appoints members of the People's Committee of the same level. In special cases, it is allowed to appoint personnel who are not People's Council delegates to hold the positions of Chairman, Vice Chairman, Head of Committees of the People's Council in the administrative unit formed after the arrangement or to act as People's Council delegates to form a provisional People's Council in wards implementing the urban government model without organizing a People's Council.
