Increase preferential allowances according to profession for preventive medicine and primary health care officials

The Government has just issued Decree 05/2023/ND-CP dated February 15, 2023 amending and supplementing a number of articles of Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government regulating preferential allowances according to profession for civil servants and public employees working at public health facilities.

Increase the preferential allowance for preventive medicine and primary health care workers to 100%, applicable from January 1, 2022 to December 31, 2023.

Specifically, add Clause 7 to Article 3 of Decree No. 56/2011/ND-CP as follows: Preferential allowance levels according to profession for preventive medicine and grassroots health officials applied from January 1, 2022 to December 31, 2023:

The 100% allowance applies to regular civil servants who directly work in preventive medicine (including border medical quarantine); work in medical profession at commune, ward, and town health stations, regional polyclinics, maternity homes, district, county, town, and provincial city health centers, and centrally run cities and hospitals at district, county, town, and provincial city levels.

According to Point c, Clause 2, Article 3 of Decree 56/2011/ND-CP, the 60% allowance applies to civil servants and public employees who regularly and directly perform border medical quarantine.

According to Clause 4, Article 3 of Decree No. 56/2011/ND-CP, the 40% allowance applies to civil servants and public employees who regularly and directly perform preventive medical expertise; testing; medical examination and treatment; infection control, patient care, rehabilitation; medical appraisal; traditional medicine; pharmaceuticals, cosmetics; food safety and hygiene, medical equipment; reproductive health at public health facilities and at nursing facilities for war invalids, sick soldiers, and people with special disabilities, except for the cases specified in Clauses 1, 2 and 3 of this Article.

During the period of application of preferential allowances according to profession for preventive medicine and grassroots health officials prescribed in Clause 7, the provisions in Point c, Clause 2 and the provisions for regular officials directly working in preventive medicine in Clause 4, Article 3 shall not apply.

Public health facilities shall, based on the provisions of this Decree, determine the funding needs for implementation in 2022 and 2023; the funding sources shall comply with the provisions of Article 4 of Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government. In case of requesting the State budget to support implementation funding, public health facilities shall send to the competent authority and the level I budget unit a report on the funding needs and the expected use of funding sources as prescribed, including the State budget support source for review, appraisal, and sending to the financial agency at the same level no later than March 31, 2023 for submission to the competent authority for consideration and decision to supplement the State budget estimate for 2023 as prescribed.

The Ministry of Finance and the People's Committees of provinces and centrally run cities are responsible for arranging funds according to the budget management decentralization for implementation.

The management, use and settlement of funds shall comply with the provisions of the law on the State budget. The unit shall be responsible for the accuracy of the data requested for State budget support in accordance with the provisions of the law.

From January 1, 2024 onwards, the preferential allowance level according to the profession for preventive medicine and grassroots health workers will be implemented according to the provisions of Clauses 1 to 6, Article 3 of Decree No. 56/2011/ND-CP, Decree amending, supplementing or replacing (if any).

* Previously, in Notice No. 7/2/2023, Deputy Prime Minister Le Minh Khai assigned the Ministry of Home Affairs to urgently preside over and coordinate with the Ministries of National Defense, Public Security, Health, Finance, Justice and relevant agencies to review current regulations on preferential allowances according to occupation for preventive medicine and grassroots health workers in the armed forces; on that basis, study and propose adjustments to preferential allowances according to occupation for preventive medicine and grassroots health workers in the armed forces to ensure compliance with Conclusion No. 25-KL/TW dated December 30, 2021 of the Politburo and legal provisions, in accordance with the practical situation and feasibility, and report to the Prime Minister before February 20, 2023.
