Penalty for many illegal construction works

Up to now, the rate of first-time land use right certificates in the town has reached 82.69%, agricultural land has reached 62.38%, forestry land has reached 51.8%. The town People's Committee has built a price list for land types for the period 2015-2019.

The town reclaimed 183,000 hectares of land for the implementation of 86 projects, most of which were effective, while the Hoang Mai Industrial Park project with an area of ​​nearly 300 hectares has existed for many years and is currently attracting investment.

In addition to the results achieved in land use, the implementation of land policies in the town still has many shortcomings, obstacles, and violations in land use such as: some organizations still have construction that is not in accordance with approved planning; some households still do not comply with land regulations such as encroachment, occupation, illegal change of purpose, and construction without a license.

From July 1, 2014 to 2018, there were 6 urban land use projects in the area that violated the law on urban planning and land law. The Town People's Committee imposed an administrative fine of 165 million VND because these projects were built without permission.

Determined to recover "suspended" projects

At the meeting, Vice Chairman of Hoang Mai Town People's Committee Ho Phi Trieu reflected on difficulties in land management in the area, that is, after 12 months of land allocation and lease, the project has not yet put the land into use or the construction progress is behind schedule compared to the project.

The Town People's Committee coordinated with the province's interdisciplinary inspection teams to inspect 16 projects that were behind schedule and submitted them to the Provincial People's Committee for consideration. As a result, the Provincial People's Committee allowed the extension of 15 projects and revoked 1 project.

Vice Chairman of Hoang Mai Town People's Committee said: "Regarding illegal construction, Mr. Trieu said that the procedures for enforcing administrative violations in the field of land are long. When violations are discovered, a record is made and a decision is made to impose administrative penalties, but during the time of mobilizing people to dismantle, they continue to violate. After completing the enforcement documents, people have already built houses and lived there, making it difficult for the enforcement work and causing great damage to the people and the State during the enforcement."

"Land and urban management are complex and sensitive areas. The town does not have an urban regulation management team, has a small staff, and a large workload. Meanwhile, site clearance for projects takes up most of the town's time, making it very difficult for the town to manage land and urban order," Mr. Ho Phi Trieu explained.

Hoang Mai Town proposed that the National Assembly consider amending the 2013 Land Law to suit reality, increasing the authority and responsibility of ward and commune People's Committee Chairmen in handling violations of illegal use and construction. At the same time, the province needs to resolutely revoke unimplemented investment projects.

Speaking at the meeting, the Deputy Head of the Provincial Delegation of National Assembly Deputies said that the management and use of urban land is one of the important supervision contents of the National Assembly. Through supervision, the legal system on urban planning, management and land use will be re-evaluated and promptly changed to suit practical requirements.

The Deputy Head of the Provincial Delegation of National Assembly Deputies noted that the People's Committee of Hoang Mai town needs to have solutions to overcome shortcomings in urban land planning, management and use; speed up the progress of granting land use right certificates; improve the quality of appraisal; develop zoning plans and detailed plans for communes and wards in the area; review slow-progressing projects, report to the Provincial People's Committee for solutions to recover suspended projects, etc.
