Chairman of Nghe An Provincial People's Committee receives citizens at regular session in June 2025

On the morning of June 16, at the Provincial Citizen Reception Office, Comrade Le Hong Vinh - Deputy Secretary of the Provincial Party Committee, Chairman of the People's Committee of Nghe An province received citizens at the regular session in June 2025.

Also attending were representatives of Party Committees, the Provincial Party Committee's Inspection Commission; the Provincial People's Council Standing Committee, the Provincial Vietnam Fatherland Front Committee, and leaders of relevant departments, branches, and localities.

Proposal to grant land use right certificates related to the 500 kV line project, circuit 2, since 2005

The Chairman of the Provincial People's Committee received Mr. Nguyen Nam Kim and a number of citizens residing in Thinh My hamlet, Nghia My commune, Thai Hoa town, requesting competent authorities to determine compensation land, convert resettlement land and issue Land Use Right Certificates (LURCs) to households whose land was recovered to implement the 500 kV line project, circuit 2, since 2005.

According to the households, in 2005, when implementing the 500kV line 2 project, the land of some households in Nghia My commune was confiscated to serve the construction. The households received full compensation, support and relocated, handing over the land on schedule. However, after moving, due to lack of conditions to create new housing, the households could not stabilize their permanent residence.

To solve the housing needs of affected households, on March 28, 2005, the People's Committee of Nghia My commune organized a lottery for 7 households to choose resettlement land plots. The households paid land use fees at the rate of 5,000 VND/m2, with a total amount of 1.5 million VND/household. The entire amount paid by the 7 households was paid by the People's Committee of Nghia My commune to the State budget.

By October 19, 2022, the above households will apply for the first land use right certificate at the One-stop Department of Thai Hoa town. After that, the households will receive a Notice of land use fee payment.

However, due to disagreement with the amount of money to be paid, claiming that they had paid the money since 2005, the households filed a petition, requesting to be reconsidered and granted a land use right certificate without having to pay additional land use fees.

Based on the petition, the People's Committee of Thai Hoa town established an interdisciplinary team to inspect, review and advise on handling the case, thereby concluding that the People's Committee of Nghia My commune organized land allocation to households in 2005 without proper authority.

At the same time, at that time, the People's Committee of Nghia My commune collected land rent at the unit price of VND 5,000/m² and paid it to the budget. However, according to the Decision of the People's Committee of Nghe An province on the land price list in 2005, the land price in that area was VND 50,000/m², 10 times higher than the collection rate.

This leads to the current situation where the application for land use right certificates for households does not have enough basis to determine financial obligations as "previously completed".

After listening to citizens' opinions and discussing with representatives of relevant departments, branches and localities, Chairman of the Provincial People's Committee Le Hong Vinh concluded this content. Thereby, it is assessed that, in essence, the local government at that time had flexibility in arranging resettlement land to create conditions for people to stabilize their housing after their land was recovered to implement the 500kV line project, circuit 2.

However, based on legal regulations and records, the land allocation at that time was determined to be beyond the authority. The reason was that the compensation plan approved in 2005 did not include resettlement, but only supported people to relocate.

On that basis, the Chairman of the Provincial People's Committee emphasized: The settlement of the case must be based on the provisions of the law but must be approached in a flexible and most beneficial way for the people. Currently, according to the provisions of the 2013 Land Law and its implementing documents, the People's Committee of Thai Hoa town is applying policies that are beneficial to the people in determining financial obligations when granting land use right certificates; striving to complete before July 1, 2025.

40 households petition for land compensation at Youth Volunteer Force 6 (old)

On the same morning, the Chairman of Nghe An Provincial People's Committee received Mr. Nguyen Van Nghi and a number of citizens residing in Dong Tien hamlet, Dong Thanh commune, Yen Thanh district, requesting competent authorities to resolve compensation and support for site clearance (GPMB) for the project of raising dairy cows and processing milk on an industrial scale and developing the economy at the Youth Volunteer Team 6 - Nghe An Construction and Development (now Dong Bac Forestry Development Joint Stock Company).

Regarding the complaints of households, after reviewing, Yen Thanh District People's Committee found that due to shortcomings in the process of preparing the survey and measurement files to serve the compensation for project site clearance, there were 40 households who were members of the General Team with properties on land including houses that had been compensated for the constructions and architectural objects but had not been compensated for residential land (according to the standard of 400 m2/household), relocation support money, rental support money and 3 households compensated for the wrong type of land compared to the current status of use on the ground.

After fully listening to the opinions of the legal representatives of the households, the functional departments, agencies, and local authorities, Chairman of the Provincial People's Committee Le Hong Vinh concluded: The key issue now is to clarify the origin of land use of the 40 houses mentioned above, from which there will be sufficient legal basis to determine whether compensation is required or not.

Because the project implementation process had previously made the compensation plan public so that people knew and agreed before approval. However, in reality, there are still a large number of households that have not been compensated for their residential land, this is a key issue that needs to be clarified.

Therefore, to completely resolve the problem, the Chairman of the Provincial People's Committee assigned the People's Committee of Yen Thanh district to preside over and coordinate with relevant departments and branches, including the Departments of Agriculture and Environment, Finance, Construction and Nghe An Provincial Youth Union, to urgently review all related policies.

Based on the review, if any content is found to be related to the legitimate rights of the people, it must be returned to the people. On the contrary, if there are not enough legal conditions, it is necessary to explain clearly and transparently; in which, the People's Committee of Yen Thanh district re-establishes a plan for compensation and additional site clearance (if any).

Chairman of the Provincial People's Committee Le Hong Vinh requested that lawyers representing households coordinate with local authorities in collecting and providing relevant legal documents, clarifying each arising factor to support the process of formulating plans and making final decisions.
