The Chairman of the People's Committee of Nghe An province held a regular citizen reception session in June 2025.

Also attending were representatives from the Party Committees, the Provincial Party Committee's Inspection Commission; the Standing Committee of the Provincial People's Council, the Provincial Committee of the Vietnam Fatherland Front, and leaders of relevant departments, agencies, and localities.

Request for issuance of land use right certificates related to the 500 kV circuit 2 power line project from 2005.

The Chairman of the Provincial People's Committee received Mr. Nguyen Nam Kim and several citizens residing in Thinh My hamlet, Nghia My commune, Thai Hoa town, who petitioned the competent authorities to determine compensation land, convert resettlement land, and issue Land Use Right Certificates (LURCs) to households whose land was confiscated for the implementation of the 500 kV power line project (circuit 2) since 2005.

According to the residents, in 2005, when the 500kV power line project (circuit 2) was implemented, the land of some households in Nghia My commune was confiscated for construction. The households received full compensation and support, relocated, and handed over the land on schedule. However, after relocating, due to a lack of resources to establish new housing, the households were unable to settle down permanently.

To address the housing needs of the affected households, on March 28, 2005, the People's Committee of Nghia My commune organized a lottery for seven households to select resettlement plots. The households paid land use fees at a rate of 5,000 VND/m², totaling 1.5 million VND per household. The entire amount paid by the seven households was deposited into the state budget by the People's Committee of Nghia My commune.

On October 19, 2022, the aforementioned households submitted applications for the first-time issuance of land use right certificates at the One-Stop Service Center of Thai Hoa town. Subsequently, the households received notices to pay land use fees.

However, disagreeing with the amount to be paid, and claiming they had already paid in 2005, the households submitted a petition requesting a review and the issuance of land use right certificates without having to pay additional land use fees.

Based on the petition, the People's Committee of Thai Hoa town established an inter-agency team to inspect, review, and advise on handling the case. The team concluded that the People's Committee of Nghia My commune's allocation of land to households in 2005 was outside its authority.

At the same time, the People's Committee of Nghia My commune collected land fees at a rate of 5,000 VND/m² and deposited them into the budget. However, according to the Decision of the People's Committee of Nghe An province on the land price list in 2005, the land price in that area was 50,000 VND/m², which was 10 times higher than the collected amount.

Consequently, the current land use right certificate application files for households lack sufficient grounds to determine financial obligations under the "previously completed" category.

After listening to citizens' opinions and discussing with representatives from relevant departments, agencies, and localities, the Chairman of the Provincial People's Committee, Le Hong Vinh, concluded on this matter. He assessed that, in essence, the local government at that time had shown flexibility in allocating resettlement land to facilitate people's stable housing after their land was confiscated for the 500kV power line project (circuit 2).

However, based on legal regulations and records, the land allocation at that time was determined to be beyond the authority of the landowners. The reason is that the compensation plan approved in 2005 did not include provisions for resettlement, but only for assisting people in relocating.

Based on that, the Chairman of the Provincial People's Committee emphasized: The resolution of the case must be based on the correct legal regulations, but should be approached in a flexible manner and in the best interest of the people. Currently, according to the provisions of the 2013 Land Law and its implementing guidelines, the People's Committee of Thai Hoa town is applying policies that benefit the people in determining financial obligations when issuing land use right certificates; striving to complete this before July 1, 2025.

40 households petition for land compensation at the former Youth Volunteer Brigade No. 6.

On the morning of the same day, the Chairman of the People's Committee of Nghe An province received Mr. Nguyen Van Nghi and several citizens residing in Dong Tien hamlet, Dong Thanh commune, Yen Thanh district, who petitioned the competent authorities to resolve the issue of compensation and support for land clearance for the large-scale industrial dairy farming and milk processing project and economic development at the Nghe An Youth Volunteer Brigade 6 - Economic Development Joint Stock Company (now Dong Bac Forestry Development Joint Stock Company).

Regarding the complaints from the households, after reviewing the matter, the People's Committee of Yen Thanh District found that, due to shortcomings in the process of preparing land survey documents for compensation and land clearance for the project, there are still 40 households of team members with structures and assets on the land (houses) who have been compensated for the structures and buildings but have not yet been compensated for the land (according to the standard of 400 m²).²(per household), relocation assistance, housing rental assistance, and compensation for 3 households who received incorrect land classification compared to the actual land use on the ground.

After listening to the opinions of the residents' lawyers, relevant departments and agencies, and local authorities, the Chairman of the Provincial People's Committee, Le Hong Vinh, concluded: The key issue now is to clarify the origin of land use for the 40 houses mentioned above, only then will there be sufficient legal basis to determine whether or not compensation is required.

Because the previous project implementation process publicly disclosed the compensation plan so that people could be aware of it and agree before approval. However, in reality, a large number of households have not yet received compensation for their residential land, and this is a key issue that needs to be clarified.

Therefore, to definitively resolve the issue, the Chairman of the Provincial People's Committee assigned the Yen Thanh District People's Committee to take the lead and coordinate with relevant departments and agencies, including the Departments of Agriculture and Environment, Finance, Construction, and the Nghe An Provincial Youth Union, to urgently review all related policies.

Based on the review, if any content is found to be in the legitimate interests of the people, it must be returned to them. Conversely, if there are insufficient legal conditions, a clear and transparent explanation is needed; in which the People's Committee of Yen Thanh district shall revise the compensation and land clearance plan (if any).

Chairman of the Provincial People's Committee Le Hong Vinh requested that lawyers representing the households cooperate with the local authorities in collecting and providing relevant legal documents, clarifying each arising factor to support the process of developing a plan and making the final decision.
