Chairman of the Provincial People's Committee Nguyen Duc Trung periodically receives citizens in August 2023

Comrade Nguyen Duc Trung - Chairman of the Provincial People's Committee received citizen Tran Ba ​​Dinh, residing in Toan Luc village, An Hoa commune (Quynh Luu district). Mr. Dinh complained about the An Hoa commune People's Committee reclaiming 80m2 of his family's land to expand the gate and fence of the commune's Kindergarten without notification, without a decision to reclaim the land, and without compensation or support for his family. Mr. Dinh hopes that Quynh Luu district will provide him with resettlement land to stabilize his life.

Reporting the incident, Chairman of the People's Committee of An Hoa Commune (Quynh Luu District) Ho Anh Dung said that Mr. Tran Ba ​​Dinh is the owner of land plot No. 1285, map sheet No. 01, which was granted a land use right certificate by the People's Committee of Quynh Luu District in 1996, with an area of ​​100 square meters of residential land. Mr. Dinh's land plot is adjacent to the An Hoa Commune Kindergarten.

In 2017, during Mr. Dinh's absence, Mr. Vo Ngoc Hung was in charge of looking after and borrowing Mr. Dinh's land and plot. The People's Committee of An Hoa commune worked with Mr. Hung and agreed to dismantle and clear the construction site and reclaim 80 square meters of land belonging to Mr. Dinh's plot to expand the kindergarten campus.

During the meeting between the People's Committee of An Hoa Commune and Mr. Hung at that time, Mr. Tran Ba ​​Dinh, the land user, was not present. The People's Committee of An Hoa Commune did not carry out the required procedures for the competent authority to issue a decision to reclaim the land and a compensation plan for Mr. Dinh's family.

Currently, Mr. Dinh is using land plot No. 74, map sheet 16 temporarily assigned by the People's Committee of An Hoa commune, but because this land plot is located in the traffic safety corridor and was assigned by the People's Committee of An Hoa commune after July 1, 2014, it does not meet the conditions for consideration for the issuance of a Land Use Rights Certificate.

Chairman of Quynh Luu District People's Committee Hoang Van Bo said that in 2017, the commune expanded the kindergarten campus but illegally reclaimed land from local people and did not report to the district. If the local people and the commune cannot agree on the compensation amount, the district will direct the commune to establish an investment project to continue expanding the kindergarten campus, reclaim the land plot and compensate the local people according to regulations.

After listening to the report of Quynh Luu district and An Hoa commune, Chairman of the Provincial People's Committee Nguyen Duc Trung assessed that the purpose of the commune reclaiming Mr. Dinh's land to expand the kindergarten campus was good, meeting the people's wishes, ensuring operating conditions for the school, ensuring learning and playing space for the children. However, the commune's actions were not within its authority, not in accordance with the law, affecting the land use rights of citizens that have been recognized by the state.

Emphasizing the responsibility of the government to care about protecting the legitimate and legal rights and interests of the people, Chairman of the Provincial People's Committee Nguyen Duc Trung requested An Hoa commune to seriously learn from experience; Quynh Luu district People's Committee to review and clarify the responsibilities of related individuals and organizations.

To resolve the petition and ensure the legitimate rights of citizens, Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the People's Committee of Quynh Luu district to study a plan to handle the compensation and resettlement of land area that was illegally recovered for Mr. Tran Ba ​​Dinh. Quynh Luu district needs to determine a suitable land location to arrange resettlement for people or compensate in cash in case the citizens and the government reach an agreement.

The Chairman of the Provincial People's Committee requested that before September 15, 2023, Quynh Luu district must report the handling plan to the Provincial People's Reception Council and notify citizens; before December 31, 2023, the case must be completely resolved. The Department of Natural Resources and Environment supports and guides Quynh Luu district to resolve problems during the implementation process.
