According to Decree 168/2024/ND-CP, motorcyclists who illegally overtake will be fined at specific levels depending on the nature and severity of the violation.
Specifically, motorcyclists will be fined from VND200,000 to VND400,000 if they do not signal before overtaking or have signal but do not use it during the overtaking process (according to Point b, Clause 1, Article 7). In case of overtaking on the right side in violation of regulations, violators will be fined from VND600,000 to VND800,000 (according to Point d, Clause 3, Article 7).
If overtaking is not allowed, or on a road section with a sign prohibiting overtaking for motorbikes, the fine will be from 800,000 VND to 1,000,000 VND (according to Point c, Clause 4, Article 7). More seriously, if the act of overtaking illegally causes a traffic accident, the driver will be fined from 10,000,000 VND to 14,000,000 VND and have 10 points deducted from the driver's license (according to Point a, Clause 10 and Point d, Clause 13, Article 7).

To ensure safety and avoid being fined, motorcyclists must comply with the regulations when overtaking. Specifically, they must carefully observe traffic conditions ahead, ensure there are no obstacles, no vehicles going in the opposite direction, and do not overtake on roads with no overtaking signs or dangerous areas such as curves, bridges, tunnels, three-way and four-way intersections. Before overtaking, the driver must turn on the turn signal to notify the intention to overtake and maintain the signal throughout the overtaking process. Overtake on the left is only allowed under permitted conditions and absolutely must not overtake when there is a risk of danger to yourself and others.
