Illegal construction projects and encroachment outside the boundary in Hung Nguyen still blatantly exist
(Baonghean.vn) - The project of the General Service and Entertainment Business Area in Chau Nhan Commune, Hung Nguyen District of Bach Bach Phat Company Limited, although built in violation of planning, many items encroaching outside the boundary, has still existed blatantly for the past 5 years as if nothing had happened.
Construction against planning
Bach Bach Phat Company Limited was approved for investment policy by Nghe An Provincial People's Committee.Project of Complex Service Business and Entertainment Areain Hung Chau commune (now Chau Nhan commune) according to Decision No. 5770/QD-UBND dated November 21, 2016. According to the decision to accept the investment policy, in 2016, this area had 4,300m2Aquaculture land under the use of households and individuals after land consolidation and plot exchange, not yet granted a Land Use Right Certificate but eligible for a Land Use Right Certificate; has 4,100m2was land managed by the People's Committee of Hung Chau commune at that time, on the cadastral map it was shown as rice land, but in reality it was land left fallow for many years without production.
The scale of the project is expected to invest in the following items: Company office and staff rest area, 3 floors high, land area 235m22; 3-storey restaurant, area 750m22; mini soccer field; 1-storey sports business building, area 200m22; fish pond, lakeside refreshment house, 1 floor high, area 200m2; other auxiliary works... This project has a total investment of 22 billion VND, with an operating period of 50 years from the date of investment policy approval. In particular, this project is not eligible for preferential policies and investment support according to the provisions of the Investment Law and Nghe An province.

After the investor hired a consulting unit to conduct a survey of the current status of the land, a detailed plan of 1/500 was established. On June 16, 2017, the Provincial People's Committee issued Decision 2599/QD.UBND approving the detailed construction plan of 1/500 with a total planned construction land area of 7,534.44m2.2. According to the approved planning, the investor has divided the project into 2 areas. Area A includes the following items: Entrance gate; 1-storey company office and staff rest house; 1-storey sports business house; 1-storey lakeside refreshment house; fish pond for entertainment; garden. Area B includes the following items: Entrance gate; 2-storey event house; artificial turf; garage; garden.
From 2017 to 2018, the investor constructed a number of projects on the above land. However, it is worth mentioning that most of the construction projects as they are currently in place are not in accordance with the planning.

After receiving the feedback, we were present at Chau Nhan commune, where Bach Bach Phat Company Limited implemented the project of the General Service and Entertainment Business Area. At the scene, we noticed that from Provincial Road 542B from Vinh to Lam River, this cluster of constructions is on the right. Among them, there is an artificial football field and 4 houses from 1 to 2 floors located close together. Through comparison, we found that these buildings were not built in accordance with the approved planning drawings.

After completing construction in 2018, Bach Bach Phat Company Limited put these projects into use. On April 27, 2021, this unit was also granted a Land Use Rights Certificate by the Department of Natural Resources and Environment for 2 areas: Area A with an area of 3,032.1m2and area B is 4,500.3m2.
It is worth mentioning that although the construction was against approved planning and had been punished, until now, this project still blatantly exists without being handled.
Working with us, Mr. Le Khanh Quang - Chairman of Chau Nhan Commune People's Committee confirmed that the local government had administratively sanctioned this investor twice, and then reported to the district for handling because it exceeded the local authority to sanction. In particular, at the time of construction, the commune knew and suspended the project, but the enterprise still deliberately carried it out.

It is worth mentioning that the People's Committee of Hung Nguyen district has also established a verification team. By April 5, 2022, there was Report No. 491/UBND-KTHT clarifying this issue. According to the People's Committee of Hung Nguyen district, based on the Decision approving the planning and the 1/500 scale planning drawing, this project is divided into 2 areas A and B. In which, area A is the construction items that have been granted a Construction Permit but the investor has not yet implemented; while area B has not been granted a Construction Permit, many construction items have been constructed and the construction items are also built in the wrong planning location.
Specifically: The entrance gate and fence are 78.96m long and are built outside the project boundary; The land area for building a 2-storey event house, with a construction area of 900m2.2, but the investor built an additional 2-storey house with an area of about 240m22, 1 children's playhouse with an area of 137m22(not in the planning); 1 2-storey house with a construction land area of about 607m22, including 105m2construction is not in accordance with planning and about 84m2built outside the boundary. In addition, there is a garden with an area of about 416m2built outside the project boundary.

Also according to Report 491 of Hung Nguyen District People's Committee, construction works not included in the planning and built outside the project boundary in Area B were not granted a certificate of design approval for fire prevention and fighting. At the time of the inspection by Hung Nguyen District People's Committee, the investor had not fully built waste collection and treatment works as registered in the environmental protection plan. The investor also built construction items outside the planning land area approved by competent authorities for about 500m.2.
The People's Committee of Hung Nguyen district also informed that it has issued a decision to impose administrative penalties on the investor. The investor must immediately stop all activities in the project and provide complete documents in accordance with the law before resuming operations.
However, according to our investigation, the construction items that are not in accordance with the planning of Bach Bach Phat Company Limited have not been handled yet. Mr. Le Khanh Quang - Chairman of Chau Nhan Commune People's Committee replied that the enterprise asked to postpone the time to handle the matter.
Obviously, the illegal construction of Bach Bach Phat Company Limited was discovered, punished and requested to dismantle the illegal construction. However, for some reason, these illegal constructions have still existed for 5 years. This really needs to be clarified by the authorities.
