(Baonghean.vn) - An incident that happened more than half a year ago was thought to have been resolved, but after a drinking party, the old story was brought up again. In a fit of anger and alcohol, Le Van Hung, a resident of Quang Thanh commune, Yen Thanh district, used a hammer to hit his friend on the head, causing one to be injured and the other to go to jail.

Revenge with a hammer and nails

Although it has been more than half a year, when mentioning the incident, people who were present at the village cultural house to watch badminton that day are still shocked. According to a resident: "They invited each other to pair up to play badminton so everyone came out to watch, who would have thought that the incident would happen later. Because it only happened in a split second, everyone was surprised at that time, not understanding what was going on?"

According to the indictment, on the afternoon of October 9, 2022, Le Van Hung was invited by a friend to his house to drink alcohol. A short while later, the drinking party was joined by a group of other young people from the same village, including Thai Ba C. (born in 1995). Everyone drank happily until after 9:00 p.m., when some people stopped and went out to drink water.

At this time, they invited each other to play badminton at the village cultural house, so they split up to play. During the pairing process, Hung recalled the incident 7 months ago when C. used a hammer to hit him on the forehead, causing injury but did not report it to the police. Although Hung challenged him, "Do you dare to hit back?", C. did not say anything and went outside. After C. went outside, C.'s younger brother said something that made Hung angry. Thinking back to the past between him and C., Hung was angry with his younger brother, so he had the idea of ​​revenge.

Hung went looking for a hammer and waited for the right moment to commit the crime. Taking advantage of the moment when Mr. C. was sitting alone on the motorbike, Hung suddenly took the hammer and hit the victim in the head, causing him to fall to the ground. After committing the crime, Hung took the hammer and ran home to inform his mother that he had just beaten someone. With encouragement from his family, the next day Le Van Hung turned himself in to the police, admitting to the beating.

As for the victim, that same night he was taken to the hospital for emergency treatment. Authorities concluded that Mr. C. suffered a brain contusion, subdural hematoma, skull fracture, and a 51% body injury rate due to the injury.

Expensive lesson

On May 10, the People's Court of Nghe An province opened the first instance trial of defendant Le Van Hung (born 1997), residing in Quang Thanh commune, Yen Thanh district, for the crime of "Murder", attracting the attention of many people. Everyone had many concerns when a happy drinking party turned into a brawl that left one person injured and another in trouble. At the trial, a group of young men who sat at the same drinking table with the defendant and the victim that day were also summoned to court as witnesses.

In the victim's row, Thai Ba C. (28 years old) sat quietly, his face sad. After being hit in the head with a hammer by Hung, after months of treatment in the hospital, his health still had not fully recovered. This young man said that he had undergone two head surgeries, so now every time the weather changes, he feels pain.

Not only his health but also his work was affected. The victim confided: “From a healthy young man, driving to earn money every day, I now dare not hold the wheel because my mind is not like before.”

At the witness stand, defendant Le Van Hung showed a sincere attitude and admitted to his crime. Hung confessed that he used a hammer to hit the victim's head because he was angry when he remembered an old conflict in which he was hit in the head by C. Moreover, the victim's younger brother had said some harsh words, so the defendant was even more upset.

“That day, I was drunk and could not control my actions,” Hung testified. At the trial, the defendant apologized to the victim and asked the court to consider reducing his sentence so that he could return to his life and take care of his mother.

The defendant presented to the panel of judges that despite his family's difficult circumstances, having lost his father and only having his mother, after the incident, he had influenced his family to compensate the victim. Accordingly, the defendant's family paid all the hospital fees for the victim's treatment and compensated Mr. C 200 million VND. Attending the court, the victim asked for a reduced sentence for the defendant.

In the presence of the people, the panel also reminded everyone to be more careful about their words in daily life. Because there are very small stories that are not resolved satisfactorily and continue to smolder, leading to serious consequences. In this case, just because of old conflicts, the defendant acted like a thug, disregarding the lives of others. Moreover, the cause of the incident was partly because the parties had been drinking, and there were inappropriate words and gestures that made the other party angry. From there, it led to someone being in trouble with the law, someone being injured, affecting their health. More than that, the relationship of neighborly love was more or less cracked.

The panel of judges determined that the defendant's act of using a hammer to hit another person's head was particularly dangerous, demonstrating a violent and hooligan nature, and amounted to murder. The defendant was aware that human life and health are precious assets, always respected and protected by the law, and anyone who illegally violates them will be severely punished. In this case, just because of a small conflict in life, the defendant used a hammer to hit a vital area on the victim's body. The victim did not die because he received timely emergency care. Therefore, it is necessary to deal with it seriously to have a deterrent and general prevention effect.

However, it is also necessary to consider some mitigating circumstances for the defendant such as surrendering, honestly confessing, influencing the family to compensate the victim, the victim asking for a reduced sentence for the defendant... Considering the entire case, the panel sentenced defendant Le Van Hung to 8 years in prison for the crime ofKilling.

Hearing the verdict, Hung tried to turn his head to look at his mother who was crying for her son. Raising his handcuffed hands to wave to his relatives, the defendant apologized to everyone in a choked voice. On the other row, Mr. C. also quietly left. Although he was saved after Hung's hammer blow, the thing this young man was most worried about was his long-term health.

It can be seen that because of a moment of anger and not being able to control himself, Le Van Hung now has to pay the price with months in prison, and Mr. C. has suffered long-term health effects. Hopefully, this will be a lesson for many people, before every incident, they need to consider carefully so as not to pay a high price.
