What is the penalty for stopping in the wrong place wearing a raincoat?
Ms. Tran Thi Mai, resident of Vinh Loc ward, asked: Every time I go on the road when it rains, I see many people randomly stopping their vehicles anywhere on the road to put on raincoats. I would like to ask, is the act of stopping in the middle of the road to put on raincoats in an unauthorized place punishable? If so, what is the fine?
Reply:
According to current regulations, the law does not prohibit stopping the vehicle to put on a raincoat. However, stopping the vehicle must comply with the provisions of the Law on Road Traffic Order and Safety to ensure safety for yourself and those around you.
Thus, if the driver stops to put on a raincoat but stops in an unauthorized location, he will be fined.
Pursuant to Decree 168/2024/ND-CP, the fine for illegal stopping and parking is as follows:
1. For motorcyclists:
Fine from 400,000 VND to 600,000 VND for the following acts:
- Stopping or parking on the roadway outside urban areas where there is a sidewalk (Point a, Clause 2, Article 7, Decree 168/2024/ND-CP).
- Stopping or parking on the roadway, causing traffic obstruction (Point d, Clause 2, Article 7, Decree 168/2024/ND-CP).
- Stopping or parking at pick-up and drop-off points, at road intersections, on pedestrian crossings; stopping where there is a "No stopping and parking" sign; parking where there is a "No parking" or "No stopping and parking" sign; not complying with regulations on stopping and parking at road intersections at the same level as railways; stopping and parking within the railway traffic safety corridor (Point e, Clause 2, Article 7, Decree 168/2024/ND-CP).
Fine from 600,000 VND to 800,000 VND for the act of: Stopping or parking on the bridge (Point c, Clause 3, Article 7, Decree 168/2024/ND-CP).
Fine from 800,000 VND to 1,000,000 VND for the act of: Stopping or parking a vehicle in a road tunnel in an incorrect place (Point b, Clause 4, Article 7, Decree 168/2024/ND-CP).
Fines from VND 10,000,000 to VND 14,000,000 for the act of: Stopping or parking a vehicle in an illegal manner, causing a traffic accident (Point a, Clause 10, Article 7, Decree 168/2024/ND-CP).
2. For bicycle, motorbike and other primitive vehicle drivers
In case a bicycle, motorbike or other rudimentary vehicle driver stops his/her vehicle wearing a raincoat in violation of regulations, he/she will be fined according to Clause 1, Article 9 of Decree 168/2024/ND-CP, which is a fine of VND 100,000 to VND 200,000 in the following cases:
- Stopping suddenly; changing direction without signaling;
- Stopping or parking on the roadway outside urban areas where there is a sidewalk;
- Stopping or parking in a road tunnel in an incorrect place.
In addition to the fine, violators will also be subject to additional penalties as prescribed.
