Completed construction protection of the Project to Improve and Upgrade National Highway 7 through Luu Son Commune, Do Luong District
As reported by Nghe An Newspaper, at 7:30 this morning (June 18), the People's Committee of Do Luong district chaired the organization of construction protection for the Project to Renovate and Upgrade National Highway 7 through Luu Son commune, Do Luong district.

The project to renovate and upgrade National Highway 7, section Km0-Km36, and handle landslides caused by storms and floods in the Khe Thoi - Nam Can section of Nghe An province was approved by the Ministry of Transport from March 18, 2022, in Decision No. 333/QD-BGTVT.
Immediately after the Project to Improve and Upgrade National Highway 7, section Km0-Km36 and to handle landslides caused by storms and floods in the Khe Thoi - Nam Can section of Nghe An province (Project to Improve and Upgrade National Highway 7 through Luu Son commune) was officially implemented, on October 12, 2022, the People's Committee of Do Luong district issued Notice No. 312/TB-UBND on land recovery. Accordingly, there are 40 households in Luu Dien hamlet and 3 organizations (Gas station, Commune Post Office and Luu Son Commune People's Committee) subject to land recovery, with an area of 4,193.1m2(on a total land area of 14,144.7m2). Regarding the 40 households in Luu Dien hamlet, they were all assigned resettlement land by the People's Committee of Do Luong district in July 1996.

Of the 40 households, 34 households and individuals have houses and structures affected by the project. Of these, 17 households and individuals have some structures built after July 1, 2004 (when the 2003 Land Law took effect) on the land area of Highway 7 corridor, which are not eligible for a Land Use Rights Certificate. However, at the time of construction, the households were not suspended by the authorities. Now that the project is implemented, the households have requested compensation and support for site clearance of the structures, houses and structures that the households have invested money to build.

After checking and reviewing in detail the current land use status of the relevant households, on July 10, 2023, the People's Committee of Do Luong district issued Document No. 1469/UBND.QLDA in response to the petition. In particular, with the petition to consider compensation and support for the land area not allocated by the State and recognized land use rights, the People's Committee of Do Luong district responded:“Households using the land area of the road protection corridor (in 1996, the District People's Committee did not allocate land to households for use, but it belongs to the land fund planned for the purpose of expanding traffic routes as stipulated in Articles 61 and 62 of the 2013 Land Law) are not eligible for a Certificate of Land Use Rights, so the State will not compensate or support the land when it reclaims this land area. Therefore, the petitions of the households have no basis for consideration and resolution.”

In order to strictly consider the legality and regulations of the law when protecting the construction of national key projects, the Provincial Police and functional units have also conducted specific surveys and research steps. Thereby, it shows that protecting the construction of the Project to Improve and Upgrade National Highway 7 through Luu Son Commune is necessary.

By June 18, 24/34 households affected by the project had handed over their land, while 9 households had not complied with the policy on compensation and support for land clearance, and had not handed over their land to implement the project, forcing them to enforce and protect construction.

According to the construction protection plan approved by the People's Committee of Do Luong district in Decision No. 1853/QD-UBND dated June 14, 2024, during the project implementation process, the People's Committee of Do Luong district coordinated with the Party Committee, People's Committee, and Fatherland Front Committee of Luu Son commune to organize many meetings, dialogues, propaganda, mobilization, and response to petitions, and establish a Working Group to verify and resolve complaints according to their authority, but 9 households and individuals did not hand over the site to implement the project. The propaganda and mobilization working group established by the People's Committee of Do Luong district also met with each household and individual to propagate, mobilize, and persuade them to agree on the compensation, support, and site handover plan to implement the project, however, the households still did not comply.

On June 17, 2024, the People's Committee of Do Luong district issued Notice No. 183/TB-BTHBVTC on "Organizing the protection of the construction of the project to renovate and upgrade National Highway 7, section Km0-Km36, and handle landslides caused by storms and floods, section Khe Thoi - Nam Can, Nghe An province, through Luu Son commune".
Do Luong District People's Committee requests that units participating in construction protection must strictly follow the procedures prescribed by law; construction protection must be handled resolutely and thoroughly; and assets illegally built on the National Highway 7 corridor must be dismantled to hand over the site to the investor to implement the Project.

At the same time, it is necessary to ensure absolute safety for the lives of households and forces directly performing tasks during the construction protection process. Ensure security and order before, during and after the organization, not to create new problems affecting the security and order situation in the area.
The People's Committee of Do Luong district assigned the Chairman of the People's Committee of Luu Son commune to notify households and individuals who have illegally built or installed structures within the corridor of National Highway 7 to dismantle and move illegally built or installed structures and structures, and hand over the project site before 7:00 a.m. on June 18, 2024; in case households and individuals do not voluntarily dismantle, the Construction Protection Implementation Board will protect the construction to implement the Project according to the above time.

On the side of the People's Committee of Luu Son Commune, from June 14, 2024, Notice No. 125/TB-UBND dated June 14, 2024 was sent to related households. Thereby, the People's Committee of Luu Son Commune requested related households to voluntarily dismantle, relocate, and clear assets within the land corridor of National Highway 7, and hand over the site before June 18, 2024. However, 9 households still did not comply.
During the construction protection session, the People's Committee of Do Luong district and the functional forces followed the correct procedures according to the law; dismantled the illegally built structures and structures on the corridor and boundary of National Highway 7 to hand over the site to the investor to implement the Project. The households basically complied with the activities of the functional agencies.

By 11:30 a.m. on June 18, the construction protection work for the National Highway 7 Upgrade Project through Luu Son Commune was completed according to plan.
Mr. Tran Van Hien - Vice Chairman of Do Luong District People's Committee, Head of the construction protection implementation board said that functional units will conduct final measurements and marking, then organize immediate handover to the project investor so that contractors can proceed with construction.
