Experience from big cities like Hanoi and Ho Chi Minh City, agencies and units using public assets after merger and dissolution are recovered by the People's Committee of the province or city and handed over to land fund development centers to use the funds for compensation and clean site clearance, then auctioned off, so the revenue to the provincial budget is quite high. According to Article 7, Decree No. 167/2017 on regulations on arrangement and handling of public assets,Forms of handling houses and land when rearranging according to the following options:Retain for continued use; Reclaim; Transfer; Sell assets on land, transfer land use rights; Change land use purpose; Transfer to local authorities for management and handling; Temporarily retain for continued use and finally use houses and land to pay investors when implementing investment projects in the form of Build-Transfer Contracts...
*Article 4, Clause 2 - Decree 167/2017 of the Government on Regulations on rearrangement and handling of public assets:
2. Responsibility for developing plans for rearranging and handling houses and land is stipulated as follows:
a) Ministries, ministerial-level agencies, government agencies, and other central agencies (hereinafter referred to as ministries and central agencies) shall develop plans to rearrange and handle houses and land of agencies, organizations, units, and enterprises under their management;
b) The Provincial People's Committee assigns the Department of Finance to preside over and coordinate with departments, branches, sectors, district People's Committees, and provincial enterprises to develop a plan to rearrange and handle houses and lands of agencies, organizations, units, and enterprises under the management of the locality;
c) The People's Committee of the province with houses and land in another locality shall develop a plan to rearrange and handle houses and land of agencies, organizations, units and enterprises under its management.
3. The plan for rearranging and handling houses and land is established as a comprehensive plan for all houses and land facilities in each province and centrally-run city according to each type: Agency, organization, unit; enterprise.
In case it is necessary to rearrange and handle before having a comprehensive plan, the competent authority specified in Clause 2 of this Article shall prepare a plan and report to the competent authority or person specified in Article 6 of this Decree for consideration and decision.
