Regulations on the establishment and implementation of resettlement projects and resettlement areas
Ms. NTT in Hung Hoa commune, Vinh city asked: How are the establishment and implementation of resettlement projects and resettlement areas regulated?
Article 110 of the 2024 Land Law stipulates the establishment and implementation of resettlement projects and resettlement areas, as follows:
1. Provincial People's Committees and District People's Committees are responsible for organizing the establishment and implementation of resettlement projects in accordance with the provisions of law.

2. The resettlement area ensures the following conditions:
a) Technical infrastructure of resettlement areas must at least meet new rural standards for rural areas and urban standards for urban areas, including: roads ensuring connection with neighboring areas, lighting and household electricity, water supply and drainage systems, communications, and environmental treatment;
b) Social infrastructure in resettlement areas must ensure access to healthcare, education, culture, sports, markets, trade, services, entertainment, recreation, and cemeteries;
c) Suitable to the conditions, customs and practices of each region.
3. Resettlement sites are selected in the following order of priority:
a) At the commune-level administrative unit where the land is recovered;
b) At the district-level administrative unit where the land is recovered in cases where there is no land for resettlement at the commune-level administrative unit where the land is recovered;
c) In another area with equivalent conditions in case the district-level administrative unit where the land is recovered has no land for resettlement;
d) Priority is given to selecting land with favorable locations to form resettlement areas.
4. In resettlement areas where there is still land fund after resettlement land has been allocated, priority shall be given to individuals eligible for residential land allocation without auctioning land use rights according to the provisions of this Law; in cases where there is still land fund, land shall be allocated to individuals eligible for residential land allocation through auctioning land use rights according to the provisions of this Law.
