How many years in prison will be punished for dangerous recidivism of drug management regulations?

Reply:Pursuant to Point c, Clause 2, Article 259 of the 2015 Penal Code, amended by Clause 71, Article 1 of the Law amending the 2017 Penal Code, it is stipulated as follows:

Crime of violating regulations on management of narcotic substances, precursors, addictive drugs, and psychotropic drugs:

1. Any person responsible for managing narcotic substances, precursors, addictive drugs, or psychotropic drugs who commits one of the following acts, has been disciplined or administratively sanctioned for one of the acts specified in this Article, or has been convicted of one of the crimes specified in Chapter XX of this Code, and has not had his/her criminal record expunged, but continues to commit the violation, shall be subject to a fine of from VND 10,000,000 to VND 100,000,000 or imprisonment from 01 year to 05 years:

a. Violation of regulations on export, import, temporary import, re-export, and transit of narcotic substances, precursors, addictive drugs, or psychotropic drugs;

b. Violation of regulations on research, appraisal, production, preservation of narcotic substances, precursors, addictive drugs or psychotropic drugs;

c. Violation of regulations on delivery and transportation of narcotic substances, precursors, addictive drugs or psychotropic drugs;

d. Violation of regulations on distribution, purchase, sale, and exchange of narcotic drugs, precursors, addictive drugs, or psychotropic drugs;

d. Violating regulations on management, control, and storage of narcotic substances, precursors, addictive drugs, or psychotropic drugs at border gates, border areas, or at sea;

e. Violation of regulations on the distribution and permission to use narcotic drugs, addictive drugs or psychotropic drugs”.

2. Committing a crime in one of the following cases shall be punishable by imprisonment from 05 years to 10 years:

a. Organized;

b. Committing the crime 2 times or more;

c. Dangerous recidivism.

3. The offender may also be fined from VND 10,000,000 to VND 50,000,000, banned from holding positions, practicing a profession or doing certain jobs from 01 to 05 years.

When committing a crime of violating regulations on the management of addictive drugs in the case of dangerous recidivism, one can be sentenced to imprisonment from 05 years to 10 years.

In addition, the offender may also be fined from 10,000,000 to 50,000,000 VND, banned from holding positions, practicing a profession or doing certain jobs from 01 to 05 years.
