9X swindled into selling apartments in Vinh city, appropriating more than 4 billion VND

The People's Court of Nghe An province has just opened the first instance trial of defendant Chu Thi My Ngoc (26 years old), residing in Truong Thi ward, Vinh city, for the crimes of "Fraudulent appropriation of property" and "Forgery of seals and documents of agencies and organizations; Using fake seals or documents of agencies and organizations"; Defendant Le Xuan Manh (32 years old), residing in Nghi Truong commune, Nghi Loc district, for the crime of "Forgery of seals and documents of agencies and organizations".

According to the case, in early 2020, Chu Thi My Ngoc signed a contract to buy an apartment at Gia Thinh Phat apartment building (Ben Thuy ward, Vinh city). Ngoc then mortgaged this apartment to the bank to borrow money.

In January 2022, due to needing money to invest in stocks, Ngoc borrowed money to withdraw documents from the bank, then mortgaged it to the owner of a pawn shop in Vinh City, borrowing 900 million VND. The two parties signed and notarized the apartment transfer document.

About 4 months later, due to a lot of debt and not having money to pay the debt, Ngoc came up with the idea of ​​fraud. Although he had transferred and handed over the original documents to the pawnbroker, Ngoc reported the loss of the original apartment purchase contract to ask Gia Thinh Phat Company to reissue another set of documents with the purpose of continuing to use this set of documents to deceive others to borrow money. After being reissued the apartment purchase contract, Ngoc defrauded and appropriated nearly 700 million VND from Mr. Le Duc A.

Then, Ngoc came up with the idea of ​​falsifying apartment purchase and sale documents to commit fraud by mortgaging the apartment to borrow money for spending. From June 5 to June 13, 2022, with the help of Le Xuan Manh, the two ordered a seal bearing the name of the company and the director of the company where the apartment was sold, then forged 5 copies of Apartment Purchase and Sale Contract; 3 Minutes of Apartment Handover; 8 receipts and 4 VAT invoices of the company.

From June 16 to July 6, 2022, Ngoc used a fake Apartment Purchase Contract to defraud and appropriate property of 5 people in Vinh City and Nghi Xuan District (Ha Tinh), appropriating more than 3.6 billion VND. Thus, the total amount of money Ngoc defrauded and appropriated from 6 victims is more than 4.3 billion VND.

At the trial, the two defendants admitted to the crimes as charged in the indictment. Defendant Ngoc stated that he invested the money he defrauded from the victims in virtual currency and spent it all on personal expenses.

The jury determined that this was an especially serious case. The defendant had used any means to commit fraud, causing panic among the public and the masses, so it needed to be dealt with severely.

Considering the case as a whole, the court sentenced Chu Thi My Ngoc to 19 years in prison for Fraudulent appropriation of property, 5 years in prison for Forging seals and documents of agencies and organizations; Using fake seals or documents of agencies and organizations; The total sentence for the defendant is 24 years in prison.

Sentenced Le Xuan Manh to 3 years in prison for Forging documents of an organization. Regarding the civil part, the court ordered defendant Ngoc to compensate the victim for damages.
