Chairman of Nghe An Provincial People's Committee Nguyen Duc Trung periodically receives citizens in November
(Baonghean.vn)- On November 17, comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the People's Committee of Nghe An province chaired the regular citizen reception session in November 2022.
Also attending the meeting were representatives of the Provincial Party Committee's Internal Affairs Committee, the Provincial Party Committee Office; leaders of departments, branches, and Hung Nguyen district.
At the citizen reception session, comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee received Mr. Tran Xuan Hung and a number of citizens residing in Hamlet 6, Hung Dao Commune (Hung Nguyen District), requesting competent authorities to resolve the conversion of agricultural land into residential land in the "Dang Ngoai" rice fields for 22 households; reflecting on Mr. Tran Quoc Khanh's household and a number of families building and encroaching on public land but have not been handled.

Regarding the proposal to convert to residential land, according to Mr. Hoang Anh Tien - Vice Chairman of Hung Nguyen District People's Committee, in 1997, Hung Dao Commune People's Committee announced to pay money but the households had not paid yet, so at that time, Hung Dao Commune People's Committee had not yet allocated land to the households. Hung Dao Commune People's Committee also confirmed that there were no documents proving that the commune allocated land to the households. The households also could not prove that Hung Dao Commune People's Committee had allocated land.
On the other hand, the land that the households are petitioning for is partly agricultural land and partly unused flat land. According to the Land Use Plan until 2030 of Hung Nguyen district approved by Nghe An Provincial People's Committee, the above land is industrial park land and traffic safety corridor of National Highway 46.

On that basis, the Vice Chairman of the People's Committee of Hung Nguyen district affirmed that these land plots are not cases of land allocation without proper authority. These land plots do not meet the conditions to be considered for granting land use right certificates for residential purposes.
Regarding the content of citizens reflecting that Mr. Tran Quoc Khanh's household and some other households built and encroached on public land but have not been handled, the Vice Chairman of the People's Committee of Hung Nguyen district said that Mr. Khanh was granted a land use right certificate by the People's Committee of Hung Nguyen district with an area of 300 m2, and his family has not been granted a new land use right certificate.

During 2017 - 2018, after receiving feedback from citizens, the People's Committee of the commune inspected the land use of Mr. Tran Quoc Khanh, and found that there were constructions encroaching on adjacent agricultural land in the North and West. The People's Committee of Hung Dao commune requested Mr. Khanh to dismantle the illegal constructions and Mr. Khanh dismantled part of the constructions in the West of the land plot.
Currently, Mr. Khanh's family is still using the encroached land area in the North; the construction in the West has been dismantled, the family is continuing to use the land and raise livestock. The land that the citizen reported has a part of unused vacant land, a part of the land has been leveled and planted with annual crops. Hung Nguyen District People's Committee has directed Hung Dao Commune People's Committee to continue to inspect, review and strictly handle violations.

Speaking at the meeting, Director of the Department of Natural Resources and Environment Hoang Quoc Viet also affirmed that the land plots of the 22 households were not allocated land without proper authority. These land plots also do not meet the conditions for consideration of granting land use right certificates for residential purposes because this area is not planned for residential land.
Concluding the citizen reception session, Comrade Nguyen Duc Trung - Chairman of the Provincial People's Committee shared the wishes and desires of citizens to convert agricultural land into residential land and issue land use right certificates.
Citing the legal regulations on land, based on the case file, the Chairman of the Provincial People's Committee emphasized that the land that the citizen requested to convert has not been planned as residential land; the households do not have documents proving that they have been allocated land by the commune; the households also do not have documents proving that they have paid money.

On the other hand, this land has been planned as industrial park land and traffic safety corridor. The policy of the People's Committee of Hung Dao commune in 1997 to allocate land and notify people to pay money is also beyond its authority. Therefore, the content of the citizen's petition to convert agricultural land into residential land and issue land use right certificates in the "Dang Ngoai" rice fields is not sufficient basis for consideration and resolution.
However, to ensure the legitimate and legal rights of citizens, the Chairman of the Provincial People's Committee assigned the Department of Natural Resources and Environment to coordinate with the Department of Agriculture and Rural Development, the Department of Construction, the Provincial Inspectorate, and the People's Committee of Hung Nguyen district to review all documents and procedures for resolving citizens' petitions, based on legal regulations to consider possible solutions, especially paying attention to ensuring the rights to use agricultural land for the people.
Regarding the content of citizens' reflection on Mr. Tran Quoc Khanh's household and a number of households building and encroaching on public land but not yet handled, the Chairman of the Provincial People's Committee requested Hung Nguyen district to direct Hung Dao commune to inspect and handle strictly, thoroughly and decisively; report the results of resolving the two contents of citizens' petitions to the Chairman of the Provincial People's Committee and notify citizens before December 15, 2022.
