Chairman of the Provincial People's Committee Nguyen Duc Trung periodically receives citizens in December 2022
(Baonghean.vn) - On December 15, Comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the People's Committee of Nghe An province chaired the regular citizen reception session in December 2022.
Also attending the meeting were representatives of the Provincial Party Committee's Internal Affairs Committee, the Provincial Party Committee's Mass Mobilization Committee, the Provincial National Assembly Delegation, the Provincial Party Committee of Provincial Agencies; leaders of departments, branches and the People's Committee of Vinh City and Nghi Loc District.

Comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee received citizen Le Ngoc Tuan (residing in Hoang Dieu block, Hong Son ward, Vinh city). Mr. Tuan complained about the decision of Vinh City People's Committee and requested the competent authority to compensate more than 36m2The family's land was taken by Vinh City People's Committee to open Le Mao extended road in 2011.

Reporting on the results of handling citizens' petitions, Comrade Le Sy Chien - Vice Chairman of Vinh City People's Committee said that after receiving the citizen's petition, on December 17, 2021, Vinh City People's Committee issued a decision to establish an interdisciplinary working group to inspect and review the case.
The review results show that on May 18, 2011, Vinh City People's Committee issued Decision No. 2389 approving the compensation and support plan for site clearance for the Le Mao extended road construction project, including Mr. Le Ngoc Tuan's household.

The Vice Chairman of Vinh City People's Committee said that at that time, Mr. Tuan did not receive compensation for land clearance and did not hand over the land. Mr. Tuan also did not send a petition to Hong Son Ward People's Committee, Vinh City Land Fund Development Center or Vinh City People's Committee to complain about the incident.
"It was not until August 2, 2013 that Mr. Tuan submitted a petition to the People's Committee of Hong Son Ward requesting to measure the land plot his family was using. In 2015, Mr. Tuan submitted a petition to the People's Committee of Vinh City requesting to recognize the area of 160m2land according to the land area his family uses and pays annual land tax. By 2021, Mr. Tuan officially filed a complaint against Decision No. 2389 of Vinh City People's Committee," said Mr. Chien.

On that basis, Vinh City People's Committee affirmed that Mr. Le Ngoc Tuan's complaint against Decision No. 2389 of Vinh City People's Committee has expired according to the Law on Complaints. On the other hand, Mr. Tuan's request for compensation and support for an area of 36.2m2When the government implemented the Le Mao road extension project, there was no basis for resolution. Vinh City has responded in writing to citizens, but citizens still do not agree.
However, citizen Le Ngoc Tuan said that in 2011, citizens filed a complaint about disagreement with the compensation and site clearance plan of Vinh city and sent the petition to the People's Committee of Hong Son ward. The People's Committee of Hong Son ward also organized a meeting with citizens and grasped the situation.

At the meeting, the Provincial Inspectorate and the Department of Natural Resources and Environment agreed that, in order to resolve citizens' petitions, the Provincial People's Committee should assign the Vinh City People's Committee to issue a decision to resolve the complaint and proceed to resolve the first complaint in accordance with legal regulations.
After listening to the citizen's presentation and the opinions of the sectors, concluding on the direction to resolve the case, Chairman of the Provincial People's Committee Nguyen Duc Trung requested the Chairman of the Vinh City People's Committee to resolve the complaint and denunciation for Mr. Le Ngoc Tuan in accordance with the law. The Vinh City People's Committee inspected and reviewed the entire process of resolving the case to ensure the resolution.in accordance with regulations, ensuring the legitimate rights of citizens.

On the other hand, Vinh City People's Committee will verify and measure the correct area that Mr. Le Ngoc Tuan's household used before the project to build the extended Le Mao road was implemented. The Department of Natural Resources and Environment and the Provincial Inspectorate will guide and inspect this work. Vinh City People's Committee will report the results of the settlement to the Provincial People's Reception Council and the Chairman of the Provincial People's Committee, and notify citizens before January 15, 2023.
Next, the Chairman of the Provincial People's Committee received citizen Vo Manh Hung (residing in Khanh Hop commune, Nghi Loc district). Mr. Hung requested the competent authority to consider and grant resettlement land or grant land without auction when the state reclaims his family's land to implement the coastal road project (section through Khanh Hop commune).

Reporting the incident, Comrade Nguyen Tien Dung - Chairman of Nghi Loc District People's Committee said that in December 2020, the District People's Committee issued a decision to reclaim land and a decision to compensate and support site clearance to implement the coastal road project. The household of Ms. Nguyen Thi Nga (Mr. Vo Manh Hung's mother) had 422.3m2 reclaimed.2land for perennial crops. The total compensation and support cost is more than 1,886 billion VND and Ms. Nga's family has received the money and handed over the land to implement the project.
According to Mr. Dung, in 422.3m2Mrs. Nga's family's land was recovered, only 186.15m2.2residential land, the rest is garden land. After the state reclaimed the land, Ms. Nga's family continued to use an area of 406m2outside the project planning. Currently, Ms. Nga's family and Mr. Hung's family live on this land.

"Because the family's residential land area was recovered, it was smaller than the residential land limit of Nghi Loc district, which is 300m2.2According to Decision No. 58/2015 of Nghe An Provincial People's Committee, Ms. Nga and Mr. Hung's families are not eligible for resettlement land," affirmed the Chairman of Nghi Loc District People's Committee.
Also according to the Chairman of Nghi Loc District People's Committee, the land area the family is using is 406m2.2, including 200m2residential land and 206m2Land for perennial crops. According to the provisions of Decision No. 78/2014 of the Provincial People's Committee on promulgating regulations on land allocation without auctioning land use rights, Ms. Nga and Mr. Hung's households have household registration in the locality but already have land and houses, so they are not eligible for land allocation without auctioning land use rights.

Concluding the direction to resolve the petition of citizen Vo Manh Hung, Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the Department of Natural Resources and Environment to coordinate with the Provincial Inspectorate, Department of Transport, and Nghi Loc District People's Committee to review regulations, procedures, and consider policies to ensure legitimate and legal rights for citizens in accordance with the law.
The Chairman of the Provincial People's Committee also hopes that citizens will share the general situation of the locality based on reality, and at the same time request the Nghi Loc District People's Committee and relevant sectors to report the results of handling the case to the Provincial People's Reception Council and the Chairman of the Provincial People's Committee, and notify citizens before January 15, 2023.
