Nghe An: Disciplinary action against commune chairman and land officials for violations related to Vinh - Cua Lo road
(Baonghean.vn) - Regarding violations in the land sector when clearing the Vinh - Cua Lo road, the Chairman of Nghi Phong Commune People's Committee and a number of related officials have just received disciplinary action.
In order to carry out the site clearance for the 72m avenue connecting Vinh - Cua Lo passing through the area, in recent years, the People's Committee of Nghi Phong commune (Nghi Loc) has reviewed, granted, exchanged, and allocated land... to affected households.
However, during this process, many cases of land affected by the project were incorrectly identified by Nghi Phong commune authorities as having the origin of land use and fluctuations in land area to be granted new land use right certificates.
A typical case is the Nghi Phong commune government "steering" nearly 99 square meters of land originating from a residential road to incorporate into the Land Use Rights Certificate (LURC) for Mr. Nguyen Dinh Phong's family in Hamlet 8, Nghi Phong commune, to establish a compensation plan for the Vinh - Cua Lo connecting road project.
Specifically, in 2015, Mr. Nguyen Dinh Phong was granted a land use right certificate by Nghi Loc District People's Committee with an area of 1,872 square meters at plot number 274, map sheet number 11, the boundary of the plot shows that the North side is adjacent to a residential road.
In 2018, after land acquisition to implement the compensation project for the Vinh - Cua Lo road, Mr. Nguyen Dinh Phong's household was granted a new land use right certificate by the District People's Committee with an area of 222 square meters, the boundary of the land plot still showed that it was adjacent to the road.
However, in April 2019, Mr. Phong's family was granted a new and revised land use right certificate by Nghi Loc District People's Committee with an increased area of 321 square meters, certificate number CQ394855.

This change in area has "erased" the residential road adjacent to Mr. Phong's land and Mr. Phong's land has naturally increased to 99 square meters. In order to successfully legalize this, many documents seem to have been fraudulently prepared to comply with the land allocation conditions of the 2014 Land Law. Specifically, the adjustment to the issuance of the Land Use Right Certificate for Mr. Phong was legalized in December 2013.
However, through inspection, Nghi Loc district inspectors pointed out that: "In 2018, Mr. Nguyen Dinh Phong's household had not occupied the adjacent road of the land plot to use for garden purposes or to build works on the land. The file to correct and issue a new land use right certificate for Mr. Phong to use the road before December 2013 to build works is unrealistic."
Similarly, in the case of Mr. Pham Van Tho, the Nghi Phong commune government incorrectly determined the origin of land use at plot number 1264, map sheet number 17, leading to the illegal allocation of land and the establishment of a compensation plan for the Vinh - Cua Lo road project with a total area of thousands of square meters. In addition, through inspection, the authorities also discovered cases such as the families of Mr. Nguyen Van Tin (village 6), Nguyen Van Nhien, Nguyen Duc Dat (village 9) who were also confirmed by cadastral officers and the chairman of the Nghi Phong commune People's Committee in the land use right certificate issuance files that were illegal and inconsistent with reality.
Through inspection, the authorities determined that the above households had been compensated with billions of dong by Nghi Phong commune authorities for land acquisition. Therefore, Nghi Loc District People's Committee also requested to collect the case of Mr. Nguyen Duc Dat who paid into the temporary account of the District Finance Department the amount of 246 million dong. Collected 284.7 million dong from Mr. Nguyen Van Nhien. Requested Mr. Nguyen Dinh Phong to return the original condition of the 99m2 road area granted in the Land Use Right Certificate...

It can be seen that to legalize the determination of land use origin, grant and change of land use right certificates, increase or decrease the area of land affected by the Vinh - Cua Lo road project under construction, there is a significant responsibility of the land officials, the Chairman of Nghi Phong Commune People's Committee and related departments and offices of Nghi Loc district.
After the conclusion of the inspection of land management and use in Nghi Phong commune, Nghi Loc District People's Committee has disciplined many related officials. Specifically, Mr. Nguyen Dinh Hai - Chairman of Nghi Phong Commune People's Committee and Mr. Truong Van Hanh were disciplined by Nghi Loc District People's Committee with the form of "Warning"; 2 officials of the Land Use Rights Registration Office, Mr. Pham Thanh Cong and Mr. Tran Cong Thanh, were disciplined with the form of "Reprimand".
Mr. Nguyen Dinh Hai - Chairman of Nghi Phong Commune People's Committee confirmed the above information and said that Mr. Hai currently has a "Resignation Application" and will not participate in the new local Executive Committee. As for Mr. Truong Van Hanh, a land official, after being disciplined, he was transferred to another area.
Mr. Pham Hong Quang - Secretary of Nghi Loc District Party Committee said that the violations of relevant officials in Nghi Phong commune have been concluded by inspection. The handling of violations is in accordance with the provisions of the law.
