Recently, people doing land administrative procedures in Vinh city were stirred by the announcement of the City People's Committee to temporarily stop receiving applications for land division.

Specifically, Document No. 6886/UBND-QLDT dated November 22, 2024 of the City People's Committee sent to the Department of Natural Resources and Environment, Urban Management, Branch of Vinh City Land Registration Office, People's Committees of wards and communes has the following content:

In order to effectively implement Resolution No. 1243/NQ-UBTVQH15 dated October 24, 2024 of the National Assembly Standing Committee on the arrangement of district-level and commune-level administrative units of Nghe An province in the 2023-2025 period, ensuring convenience and stability of data and statistics on land and population to serve the general planning of Vinh city according to the new administrative boundaries, the People's Committee of Vinh city assigned the Departments of Urban Management, Natural Resources and Environment and related units, People's Committees of wards and communes to strengthen the State management of land and planning; temporarily suspend the reception, consideration and settlement of procedures related to the division of plots, land donation for road opening, and land division within the existing administrative boundaries of Vinh city.

For the backlog of files, which have been approved by competent authorities for implementation; departments, branches and units shall implement to ensure citizens' rights; at the same time, they are responsible for reporting to Vinh City People's Committee (through the Urban Management Department) to update data to ensure timeliness and consistency.

During the implementation process, if there are any problems, promptly report them to the Urban Management Department for synthesis and report to the City People's Committee for guidance and handling according to regulations.

The above document makes people who need to separate land plots in Vinh city quite confused and worried.

According to research, currently, the demand for land division in the city, especially in the suburban communes, is still quite large, with an average of 250 applications per day. Therefore, if we just temporarily stop receiving applications, the number of applications will be congested and affect the rights of the people.

In a quick exchange with us, a leader of the Provincial Land Use Rights Registration Office said: The document of the Vinh City People's Committee announcing the temporary suspension of receiving, considering, and resolving procedures related to the subdivision, donation of land for road opening, and separation of land plots within the existing administrative boundaries of Vinh City is incorrect.

Immediately after signing and promulgating the Resolutions on administrative boundary mergers for provinces, the National Assembly Standing Committee issued Conclusion No. 1036KL-UBTVQH directing many contents, including the requirement to "create the most favorable conditions for individuals and organizations; limit major disruptions to people's lives when arranging administrative boundaries...". "Although this is only a specific administrative document, Vinh city must consider and adjust accordingly," said this leader.

According to Decision No. 34/2024/QD-UBND dated September 30, 2024 of the Provincial People's Committee, stipulating other types of documents on land use rights; residential land limits, recognition of residential land, agricultural land allocation; conditions for land division and consolidation for each type of land in Nghe An province, guiding the Land LawThe land use regulations in 2024 are clearer and more favorable. Specifically, Article 8 stipulates: The limit for residential land allocation to individuals in Vinh city is not more than 150 m2/lot and Article 10 stipulates that in urban areas and towns, only residential land plots need to have a minimum area after separation and consolidation of land plots of 50 m2 and other areas of at least 80 m2 and the length of the side along the existing traffic road or walkway is at least 04m, the minimum depth is 04m to be divided into independent plots.
