Mr. Nguyen Van Hao, residing in Hung Nguyen district, asked: According to the 2024 Land Law, what principles must be ensured when using land for public purposes? How is the authority to allocate or lease land to investors to implement investment projects under the public-private partnership method regulated?
Reply:
Article 207Land Law 2024 regulates land used for public purposes; land for implementing investment projects under the public-private partnership method.as follows:
1. The use of land for public purposes must comply with the planning, land use plans, and specialized planning involving land use approved by competent authorities.
2. Land used for public purposes must clearly distinguish between land areas used for non-business purposes and land areas used for business purposes.

For land areas used for non-business purposes, the State shall allocate land without collecting land use fees according to the provisions of Article 118 of this Law; for land areas used for business purposes, the State shall lease land according to the provisions of Article 120 of this Law.
3. The State allocates or leases land to investors to implement investment projects under the public-private partnership method using land in accordance with the provisions of this Law.
4. The regime of land management, use, and financial obligations to implement investment projects under the public-private partnership method must comply with the provisions of this Law and the Law on Investment under the public-private partnership method.
5. The Provincial People's Committee is responsible for arranging land funds and allocating land to the People's Public Security force when requested to ensure security and order in land areas used for public purposes and land for implementing investment projects under the public-private partnership model.
