Building communes and wards that meet legal access standards in line with new rural goals

Make sure each criterion is met

Dien Ky is one of the two localities chosen by Dien Chau district to build advanced new rural areas, therefore, the work of building a commune that meets legal access standards (CTCPL) is highly valued. The commune has assigned each relevant officer to be in charge and score each criterion with strict supporting documents. For example, in the implementation of administrative procedures under the authority of the People's Committee at the commune level, in addition to full and timely public posting, the reception, processing, reflection, recommendations and settlement of administrative procedures are also carried out with the motto of correct order, procedures, and speed.

The proof is that in 2021, there were 2,570 records related to the fields of civil status, authentication, signature confirmation, policies, land... of which 100% were resolved in accordance with the correct procedures and deadlines. During the year, Dien Ky commune directed the collection of 385 votes from people to evaluate the quality and attitude of administrative procedure settlement service, with no dissatisfaction votes.

Similarly, all indicators in the criteria for popularizing laws are reviewed and implemented seriously. From publicizing legal documents, organizing public consultation on draft legal documents, to thoroughly understanding and popularizing relevant legal policies.

According to Mr. Tran Ngoc Doan - judicial officer of Dien Ky commune, although affected by the Covid-19 epidemic, the commune still carried out many legal propaganda activities on the loudspeaker system with 719 broadcasts; organized 5 live propaganda conferences with more than 1,000 participants; launched 3 online contests to learn about the law on elections, the Law on Anti-Corruption and the Law on Coast Guard; printed and distributed 5,000 leaflets with propaganda content on regulations on penalties in Covid-19 prevention and control, and firecracker prevention and control. In addition, the People's Committee of Dien Ky commune has directed the entire political system to actively apply IT to promote propaganda and dissemination of laws on social networks and through the fanpages of organizations and unions.

In Dien Trung commune, during the process of building and reaching the NTM finish line, the implementation of criteria to be recognized as a commune that has achieved CTCPL has received special attention, because among the criteria for building NTM, there is criterion 18 on "Political system and access to law". For example, to ensure security and order indicators, the commune police have advised the People's Committee of Dien Trung commune to deploy 10/10 hamlets to register as safe hamlets in terms of security. Thanks to that, the number of law violations in the area has decreased compared to before, and social evils have been controlled. The work of receiving petitions, resolving complaints and denunciations has been carried out in accordance with regulations.

In 2021, the commune received 9 complaints and denunciations and resolved them according to its authority (25 fewer than in 2020), with no complaints beyond its authority. 100% of administrative procedures were resolved quickly with 10,545 records in 2021. Through taking votes to assess people's satisfaction with 1,582 votes (related to procedures for certifying copies from originals, certifying signatures, birth, marriage, death, land, policies, separation procedures, ID cards, etc.), there were 1,580 votes of satisfaction, only 2 votes of dissatisfaction. Mediation work was also given attention with 10/10 hamlets having a team of mediators.

According to Ms. Hoang Thi Xuyen - Head of the Justice Department of Dien Chau district: The assessment of communes and towns meeting the CTCPL in the area is of interest to sectors and localities and is implemented according to Circular 07 of the Ministry of Justice with 5 indicators, 25 criteria, on a scale of 100 points. The review and assessment work is carried out seriously, according to the procedural order based on the maximum standard score. The People's Committees of communes and towns self-assess, score, then prepare a dossier to submit to the District Evaluation Council for re-assessment. Based on the assessment of the District CTCPL Assessment Council, the Chairman of the District People's Committee issues a Decision to recognize the commune meeting the CTCPL according to current regulations. based on the maximum standard score. The People's Committees of communes and towns self-assess, score, then prepare a dossier to submit to the District Evaluation Council for re-assessment. Based on the assessment of the District CTCPL Assessment Council, the Chairman of the District People's Committee issues a Decision to recognize the commune meeting the CTCPL according to current regulations.

The whole political system is involved.

After more than 4 years of implementing Decision No. 619/QD-TTg of the Prime Minister promulgating the Regulations on building communes, wards and towns meeting CTCPL, the number of commune-level units meeting CTCPL in Dien Chau district has continuously increased every year. In 2021 alone, Dien Chau district had 37/37 communes meeting the standards (one of 8 localities in the whole province with 100% of communes and towns meeting the standards).

To achieve this result, Dien Chau district determined that building communes and wards that meet the Law on Legal Aid is not only the task of the Judicial sector but also of the entire political system. From there, focusing on leadership, direction and implementation, striving to have at least 35 communes and towns that meet the Law on Legal Aid every year. The District People's Committee advised the District Party Committee to issue Directive No. 05-CT/HU dated May 10, 2021 on "Strengthening the Party's leadership in disseminating and educating the law, raising people's awareness of law observance; building communes and towns that meet the Law on Legal Aid, period 2021-2025". At the same time, direct agencies, departments and branches to develop implementation solutions to ensure achievement and increasingly improve the quality and effectiveness of criteria and indicators for evaluating communes meeting CTCPL, associated with the goal of building communes meeting NTM, advanced NTM, and model NTM standards, period 2021-2025.

Every year, the District People's Council has a resolution, the District People's Committee has a decision to assign targets for building communes that meet the CTCPL and issue a Plan to implement the work of disseminating and promoting the Law, mediation at the grassroots level, and building communes that meet the CTCPL in the area. The Department of Justice is assigned to preside over, regularly grasp information, reflect and make recommendations to promptly guide the resolution of difficulties and problems arising in the implementation process. At the same time, learn and collect new and good practices from localities in and outside the province for communes in the area to refer to, learn from and follow.

In particular, the work of PBPL is implemented flexibly and diversely in many forms. Especially the activities of propagating and disseminating the law on social networks. Up to now, the whole district has over 150 fanpages established and managed by departments, branches and organizations at the commune level to effectively carry out the work of propagating, disseminating and educating the law. The articles will be compiled and posted on the fanpage "Dien Chau Justice" by the Department of Justice - the Standing Office of the District Council for Dissemination and Education of the Law. Then, the fanpages of departments, branches and organizations at the commune level will share or download for posting.

Starting from 2022, the assessment of communes, wards and towns meeting the CTCPL will be carried out according to Decision No. 25/2021/QD-TTg of the Prime Minister (replacing Decision No. 619/QD-TTg). Accordingly, the criteria for communes, wards and towns meeting the CTCPL have been revised to be scientific, feasible and suitable for practice, including 5 criteria with 20 indicators, which are a tool to measure the level of fulfillment of assigned responsibilities of commune-level authorities in organizing law enforcement and implementing socialist democracy at the grassroots level.
