On May 5, 2022, at the headquarters of the Department of Natural Resources and Environment, Comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee chaired a working session with the Department of Natural Resources and Environment on the results of the implementation of the sector's tasks in the past time, directions and key tasks in the coming time.

Attending the meeting were comrades: Hoang Nghia Hieu - Member of the Provincial Party Standing Committee, Vice Chairman of the Provincial People's Committee; Nguyen Thi Kim Chi - Member of the Provincial Party Standing Committee, Secretary of the Party Committee of the Provincial Agencies; leaders of departments, branches and sectors: Office of the Provincial People's Committee, Planning and Investment, Finance, Construction, Home Affairs, Justice, Agriculture and Rural Development, Labor - Invalids and Social Affairs, Tax Department, Provincial Police, Southeast Economic Zone Management Board.
After listening to the report of the Director of the Department of Natural Resources and Environment; opinions of the members attending the meeting, Chairman of the Provincial People's Committee Nguyen Duc Trung concluded as follows:
In 2021, despite difficulties due to the impact of the pandemic, with the solidarity and efforts of the entire political system, all levels, sectors, business community and people, the province's socio-economic situation has changed positively and achieved important and comprehensive results in all fields; including important contributions from the Natural Resources and Environment sector. In recent times, the Department of Natural Resources and Environment has proactively directed the comprehensive, synchronous and drastic implementation of tasks and solutions to implement the industry's development plan goals and achieved many positive results in a number of fields:
- Advise on the development of legal documents on natural resources and environment to ensure quality and progress; Pay attention to the implementation of planning and sectoral planning, such as: Coordinating in the development of provincial planning; Land use, mineral and water resource planning; Annual land use plans; Advising on the list of projects for land recovery and conversion of land use purposes... Land management and mapping have been strengthened, better serving the management of: Land recovery, land allocation, land lease, and issuance of land use right certificates; Coordinated more effectively and focusedly in directing the management of land, minerals and environment, limiting the emergence of hot spots. The management, exploitation and use of water resources have had positive changes.
Administrative reform work is of interest: Submitting for approval the list and regulations of administrative procedures for the sector, including shortening the time for processing dossiers in the environmental sector; mineral sector and water resources sector; Effectively handling problems arising in the natural resources and environment sector, especially in compensation and site clearance for key projects of the province.
- Inspection, examination and strict handling of violations of natural resources and environment have been strengthened, thereby rectifying state management of land and recommending the revocation of projects using illegal land.
- Perform well the work of receiving citizens: Fully attend the citizen reception sessions of the provincial leaders according to regulations; Participate in delegations or proactively conduct specialized inspections and examinations; advise and promptly and properly handle complaints and denunciations related to the industry.
In addition to the achieved results, there are still some difficulties and limitations that need to be overcome in the coming time such as: Violations of land, mineral and environmental laws at the grassroots level; Slow handling of land backlog, results of granting land use right certificates have not met the set plan; The work of handling administrative procedures, improving the investment and business environment for localities, enterprises and people has not met the requirements...
In the coming time, it is recommended that the Department of Natural Resources and Environment focus on the following key tasks:
1.Resolutely, synchronously and effectively organize the implementation of state management work; closely follow the directions of the Provincial Party Committee, People's Council and Provincial People's Committee, especially the contents in the Action Program of the Resolution of the 19th Provincial Party Congress and the Socio-Economic Development Plan, period 2021 - 2025 on the field of natural resources and environment. In particular, focus on the contents related to sectoral planning, integrated into the Provincial Planning for the period 2021 - 2030, vision to 2050 to ensure synchronization and effectiveness.
2.Continue to review and advise the Provincial People's Committee to promptly issue legal documents, directives and instructions to ensure compliance with new regulations.
3.Closely coordinate with departments and branches to strengthen inspection and examination of law enforcement in the sector, inspect the state management responsibilities of local authorities; promptly detect and strictly handle violations to improve the effectiveness and efficiency of law enforcement. Pay attention to implementing well the work of receiving people, dialogue, promptly resolving complaints and denunciations, not allowing the situation of petitions going beyond the level, not allowing complicated hot spots to arise. Strengthen and carry out propaganda and dissemination of laws on natural resources and environment.
4.Coordinate with relevant departments and branches to advise the Provincial People's Committee to implement contents under the authority of the Department of Natural Resources and Environment, according to the content of Document No. 2541/CV-TCT dated April 18, 2022 of the Prime Minister's Special Working Group.
5.Focus on doing well in the following areas:
5.1.About land
- Improve the quality of appraisal of investment policy approval dossiers; dossiers of land allocation, land lease, land use purpose conversion, issuance of land use right certificates, house ownership rights and other assets attached to land; land recovery dossiers, site clearance compensation plans.
- Pay due attention to resolving land needs for religious establishments; actively coordinate with departments, branches and localities in handling cases related to religion.
- Coordinate with relevant agencies to organize the implementation of land database construction, construction of provincial cadastral records. Speed up the progress of completing cadastral survey and mapping, declaring and registering dossiers for granting land use right certificates for localities with outstanding issues.
- Advise on the allocation of land use planning targets for the 2021 - 2030 period to districts according to the land use targets assigned by the Prime Minister in Decision No. 326/QD-TTg dated March 9, 2022 (note related targets in the Provincial Planning), required to be completed before May 30, 2022.
- Urge the District People's Committee to complete the District Land Use Planning dossier for the 2021-2030 period and the 2022 Land Use Plan; promptly appraise and submit to the Provincial People's Committee for approval before June 30, 2022.
- Preside over and coordinate with relevant agencies to advise on the implementation of Decision No. 10/QD-TTg dated April 6, 2022 of the Prime Minister on regulations on procedures for approving the conversion of land use purposes for rice cultivation from 2 crops or more for a scale of less than 500 hectares; special-use forest land, upstream protection forest land under 50 hectares.
- Complete the preparation of the Land Use Plan for Nghe An province for the period 2021 - 2025, report to the Ministry of Natural Resources and Environment for appraisal, and submit to the Government for approval before July 15, 2022.
5.2.About the mineral sector.
- Implement mineral management well, ensuring strictness and efficiency from the planning stage to licensing mineral exploration and exploitation and monitoring mineral exploitation and processing activities.
- Review all qualified mineral areas in the province to integrate into the provincial planning, focusing on minerals used as common construction materials to meet development needs in the province; resolutely remove from the planning areas that do not fully meet the conditions and licensing criteria.
- Continue to guide and direct localities to effectively implement the management of natural resources and minerals in districts and towns and must link mineral exploitation and processing activities with environmental protection.
- Develop a project to monitor licensed mines for mineral exploitation by applying information technology in management, to transmit information and data in mine areas through weighing stations and camera surveillance systems of mineral exploitation units to state management agencies for monitoring and supervision.
- Implement the auction of mineral exploitation rights in the province to ensure publicity, transparency, and compliance with legal regulations. Research the auction of mineral exploitation rights combined with the auction of assets on land (if any).
- Speed up the inspection progress of the Interdisciplinary Inspection Team on mineral activities and state management work of local authorities.
5.3.On environmental protection:
- Continue to urge and supervise the implementation of the Law on Environmental Protection 2020; proactively advise the Provincial People's Committee to consider and resolve related issues within its authority.
- Strictly control environmental quality in the whole province: Promptly detect and immediately handle environmental pollution, pay attention to the treatment of domestic waste and other types of waste; strictly control investment projects after they come into operation; do not approve projects with high risk of environmental pollution. Strengthen supervision and prevention to avoid environmental pollution in production and business activities. Focus on thoroughly handling establishments causing serious environmental pollution and areas polluted by residual plant protection chemicals.
- Advise the Provincial People's Committee to issue a Plan to implement Resolution No. 08-NQ/TU dated March 2, 2022 of the Provincial Party Executive Committee on strengthening the Party's leadership in environmental protection work in the province for the period 2022 - 2030, to be completed before June 30, 2022.
5.4.On water resources and sea and islands.
- Advise the Provincial People's Committee to approve the list of intra-provincial water sources and approve the water source protection corridor in the province; carry out boundary marking for protection; inspect and monitor the quality of water sources and marine environment.
- Complete the Resolution of the Provincial Party Standing Committee on strengthening the Party's leadership to improve the effectiveness of implementing the strategy for sustainable development of the marine economy to 2030, with a vision to 2045; submit in June 2022.
5.5.Continue to effectively implement tasks in the fields of surveying, mapping and remote sensing; climate change, hydrometeorology according to regulations and in accordance with the actual situation of the province.
6.Continue to further promote administrative reform, aiming to create positive and strong changes in the field of natural resources and environment. Correct discipline, order, public ethics, awareness and responsibility of cadres, civil servants, public employees and workers in the whole industry; especially in advising on administrative procedures for businesses and people; in case of violations, strict measures must be taken. Further promote the application of information technology and digital transformation in management activities. Pay attention to implementing well the training and planning of cadres, giving priority to young, capable and promising cadres. Implement well the work of preventing corruption, practicing thrift and combating waste.
ON SUGGESTIONS AND PROPOSALS:
1.Aboutorganizational structure:Propose not to merge the Provincial Land Fund Development Center with the Center for Natural Resources and Environment Engineering, and convert the Center for Natural Resources and Environment Engineering into an autonomous unit.
Agree on the policy, assign the Department of Natural Resources and Environment to coordinate with the Departments of Home Affairs, Justice, and Finance to advise the Party Committee of the Provincial People's Committee to report to the Standing Committee of the Provincial Party Committee for comments in accordance with regulations.
2.About the cost: Assign the Department of Finance to advise the Provincial People's Committee to arrange funds for 3 years (2023 - 2025 period) to carry out the important tasks proposed by the department, in which, the land administration career fund until 2025 will be allocated at least 7% of the total revenue from land use fees, annual land rent and the environmental career fund until 2025 will be allocated at least 1% of the total annual state budget expenditure.
3. Regarding the construction of the (new) headquarters of the Department of Natural Resources and Environment:Agree on the policy, assign the Department of Planning and Investment to pay attention to quickly and promptly implementing the appraisal of the investment policy; the Department of Finance advises on allocating sufficient funds to carry out compensation and site clearance work and promptly advises on the auction of land use rights for real estate facilities according to the arrangement plan approved by the Provincial People's Committee, to soon have funds to implement the construction of the headquarters to ensure progress.
