Prosecution and detention of the subject causing disturbance at Ben Thuy 2 Toll Station

Previously, through the work of grasping the situation and coordinating information exchange, it was known that on February 9, 2019, there was a group of subjects traveling in 3 cars from Ho Chi Minh City to Hanoi on National Highway 1A.

When passing through some BOT toll stations in the South, the above group of subjects deliberately delayed and prolonged the time to pay road fees, causing traffic jams; at the same time, recorded and live-streamed clips on social networks to incite people, causing complications in security and order.

Faced with the above situation, the leaders of Nghe An Provincial Police have directed the professional departments and police of relevant localities to coordinate with BOT Toll Stations Ben Thuy 1 (Vinh City), BOT Ben Thuy 2 (Hung Nguyen District), BOT Hoang Mai (Hoang Mai Town) to proactively prepare forces and means to deploy plans to ensure security and order at BOT stations.

At around 3:00 p.m. on February 9, 2019, a group of subjects traveled in 3 cars to the Ben Thuy 2 BOT Toll Station in Hung Nguyen District, Nghe An Province. The subjects were slow to pay, using small change to pay the toll in order to prolong the time with the purpose of causing traffic congestion.

The police force deployed at the BOT station has been propagandizing and mobilizing subjects to strictly comply with the provisions of the law, not to prolong the time to buy tickets, affecting the security and order situation. After being propagandized and mobilized, 2/3 of the cars complied with buying road tickets and moving through the station.

The car with license plate 47A-13089, driven by Nguyen Quang Tuy (born in 1970, residing in Tan Bac village, Ea Kenh commune, Krong Pac district, Dak Lak province) carrying 3 other men did not comply.

Nguyen Quang Tuy drove his car through the barrier in front (which was closed) and crashed into the soft median strip, then passed the station and continued driving north.

After the driver fled, the provincial police leaders directed the traffic police force on National Highway 1A to deploy a checkpoint and arrest him for handling according to the law. When arriving at Km 444 + 220 in Nghi Loc district, the traffic police force discovered the driver and signaled him to stop the vehicle.

During the working process, despite the police's persistent propaganda and mobilization, Tuy still did not comply and did not cooperate; the accompanying subjects filmed and distributed it live on social networks.

At 7 p.m. the same day, the police force took Tuy and related people to the Hung Nguyen District Police Headquarters for questioning. During the questioning, Tuy continued to disobey and not cooperate. After the police agency decided to temporarily detain the vehicle and while they were investigating, Tuy arbitrarily left the car, got into the car, and locked the door.

The police force repeatedly propagandized, mobilized, and requested the subject to get off the vehicle and continue working, but Tuy did not comply and even acted against the authorities, forcing the Hung Nguyen District Police to control and make a record of catching the offender red-handed for resisting a person on duty.

Based on the collected documents and evidence, on February 11, the Investigation Police Agency of Hung Nguyen District Police initiated a case, prosecuted and detained Nguyen Quang Tuy for the act of "Resisting a person on official duty" under Article 330 of the 2015 Penal Code (amended and supplemented in 2017) to investigate and handle according to the provisions of law.
