Earlier this year, there was a rumor that the implementation of registration, appraisal, and issuance of land use right certificates for the first time for people in My Son was "problematic". Connecting to get information at the grassroots level, we were introduced to meet the family of Ms. Nguyen Thi Phuong, residing in Hamlet 7, My Son. The reason was: "Ms. Phuong's family's application for the first land use right certificate was "suspended" for many years. It was not until there were problems in the implementation of land clearance for the Truong Bon bypass that the district leaders came to inspect and meet to listen to Ms. Phuong's wishes that this family was approved and granted a certificate...".

Returning to Hamlet 7, My Son, Mrs. Nguyen Thi Phuong's family is living on a plot of land affected by the Truong Bon bypass. When asked, Mrs. Phuong confirmed and said: "Luckily, the road was cleared so my family could meet the district leaders and get the certificate. I also just received the certificate in December 2022..."

Regarding her family's incident, Ms. Phuong said that since 2013, her family has registered a file.Certificate of land use rights. In 2017, her family was informed to go to the village cultural house to re-sign the documents. Everything seemed to be over, but year after year her family did not receive the red book. During those years, she went to the commune many times to ask but received the answer "the cover of her cousin's family could not be made yet". There was even a time when she was "answered" by the commune officials "the documents of her family do not have yet...".

When the district was preparing to build the Truong Bon bypass, she continued to go to the commune to request a red book for her family, but the relevant officials such as Mr. L. and Mr. Tr. still gave the same answer: "Your family does not have any documents yet". Frustrated, Ms. Phuong clearly stated the timelines for making the family's documents, but these people gave the reason that "her land is in dispute" (disputed - PV). "I argued, the dispute was resolved in 2017, there was even a document... I really went through the trouble of trying to get the grass to die without success. When I asked for the documents back, they still did not give them..." - Ms. Phuong said.

Then, Ms. Phuong's family's wishes were resolved when the district leaders came to inspect the site clearance work for the Truong Bon bypass. In early December 2022, when meeting the district leaders, she stated, "My family has no difficulties. For now, when requesting a Land Use Rights Certificate, my family will sign the documents, receive money, and then comply with the site clearance." A district leader who heard the presentation called to check the land information and the land use rights certificate documents and promised: "I promise to do it for you. You just sign the documents, receive money...". After a while, Ms. Nguyen Thi Phuong's family received the red book...


Thoughts of the Party Committee Leader

Listening to the story of Ms. Nguyen Thi Phuong, we contacted to meet Party Secretary Dang Van Tu. Regarding the State management of land in general, and the issuance of first-time land use right certificates to people in particular, according to the Party Secretary of My Son commune, there are still many shortcomings, problems and problems.

Mr. Dang Van Tu presented the Notice of Conclusion of the Commune Party Committee after the review and inspection of State management work in the field of land carried out in August 2022 as evidence. According to this Notice, the reason why the My Son Commune Party Committee conducted the review and inspection was because voters had repeatedly expressed their opinions on issues related to the land sector at the Commune People's Council meetings, but the Commune People's Committee resolved them slowly and inconclusively. Therefore, the Standing Committee of the People's Council advised the Party Committee to work with the Commune People's Committee and a number of other components to organize a review and inspection of State management work in the field of land, to consider assigning the People's Committee to organize the implementation of tasks according to its authority.

Regarding the conclusion of the My Son Commune Party Committee after reviewing and inspecting, it specifically assigned the Commune People's Committee to carry out 3 groups of tasks. Assign the Commune People's Committee to thoroughly handle the encroachment and appropriation of collective land, land use in violation of regulations; conversion of agricultural and non-agricultural land to roads for individual households, to gardens for individual households. 2. Assign the Commune People's Committee to inspect the land allocation contract near the Old Cultural House (Hamlet 3), inspect that after being allocated, households are not allowed to plant perennial trees, build fences on the allocated land or convert to other purposes without the opinions of competent authorities. 3. Assign the Commune People's Committee to make a plan and design to repair rural roads, Dong Choi road in Hamlet 1. Submit to the Party Committee for promulgation of policies, assign the Commune People's Committee to allocate revenue from people's contributions to build rural roads from previous years, repair them for people to travel, and avoid re-encroachment by households along that road section. The implementation time is before the fourth quarter of 2022".


Regarding the work of granting first-time land use right certificates to households in the area, Mr. Dang Van Tu said that there are still many backlogs. Recognizing that besides objective reasons, there are also subjective reasons, Mr. Tu informed that the whole My Son commune has 7 hamlets with 1,756 households and 5,674 people. Currently, there are still about 500 households that have not been granted the first red book. There were years when the whole commune only issued a few red books...

Regarding the case of Ms. Nguyen Thi Phuong's family, the Secretary of the My Son Commune Party Committee said that he witnessed her presenting to the district leaders her wish to be granted a Land Use Right Certificate for the first time for her family. "The Party Committee and socio-political organizations regularly participate in mass mobilization work, mobilizing people to support the work of site clearance for projects in the area. CHECKING THE RESPONSIBILITY OF COMMUNE OFFICERS AND CIVIL SERVANTS

To better understand the process of granting the first Land Use Right Certificate to Ms. Nguyen Thi Phuong's household, we contacted the People's Committee of Do Luong district. According to the representative of the district People's Committee, immediately after hearing Ms. Nguyen Thi Phuong's wishes, the district checked the documents and verified the land origin of this household. After that, the specialized department, the Branch of the District Land Registration Office, carried out the process of granting them the Land Use Right Certificate. "The time from grasping the wishes to delivering the Land Use Right Certificate to Ms. Phuong's family was all in December 2022..." - the representative discussed.

Speaking of concerns in the work of granting the first Land Use Right Certificate in My Son commune, according to the representative, on February 23, 2023, the District People's Committee issued Decision No. 438/QD-UBND on the establishment of an Inspection Team to perform public duties in the State management of land in My Son commune.

The inspection team will be responsible for inspecting the performance of public duties by officials and civil servants in the State management of land; inspecting the implementation of receiving and resolving assigned tasks for individuals and organizations under its authority; the inspected subjects include the Chairman of the Commune People's Committee, land officials and related components.

“The inspection period of the Delegation is determined from the effective date of the decision to March 30, 2023. After this period, the Inspection Delegation will have a report for the District People's Committee to accurately assess the performance of public duties of officials and civil servants in the State management of land in My Son commune.
